ORDINANCE NO. 20292 <br /> <br />AN ORDINANCE A3,{ENDING THE EUGENE-SPRINGFIELD <br />METROPOLITAN AREA GENERAL PLAN TEXT, CHAPTER <br />III, SECTION D, POLICY #13; ADOPTING AN EXCEPTION <br />TO STATEWlDE PLANNING GOAL 15 WILLAMETTE <br />RIVER GREENWAY; ADOPTING A SEVERABILITY <br />CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br /> A. Chapter IV of the Eugene-Springfield Metropolitan Area General Plan ("Metro Plan") <br />sets forth procedures for amendment of the Metro Plan, which for Lane County are implemented by <br />the provisions of Eugene Code (EC) 9.7700 through 9.7750. <br /> <br /> B. On May 5, 2003, the Springfield City Council initiated proceedings for a Metro Plan <br />amendment and Exception to Goal 15 Willamette River Greenway, <br /> <br /> C. Following a June 3, 2003 joint public hearing with the Springfield and Lane County <br />Plannir~g Commissions, the Eugene Planning Coramission, on June 3, 2003, recommended Metro <br />Plan amendments taking an exception to Statewide Planning Goal 15 Willamette River Greenway, <br />to the Eugene City Council. <br /> <br /> D. The Eugene City Council conducted a joint public hearing on this anaendment on June <br />18, 2003, with the Springfield City Council and Lane County Board of Commissioners, and is now <br />ready to take action based upon the above recommendations and evidence and tesfimor;y already in <br />the record as well as the evidence and testimony presented at the joint elected officials public <br />hearing. <br /> <br /> E. Substantial evidence exists within the record demonstrating that the proposal meets the <br />requirements of the Metro Plan, of Chapter 9 of the Eugene Code, 1971, and of applicable state and <br />local law as described in Exhibit A, attached, and which are adopted in support of this Ordinance~ <br /> <br />NOW, THEREFORE <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br /> Section 1. The Metro Plan Policy # 13, Chapter III, Section D. is hereby amended by addition <br />of the following paragraph: <br /> <br />"An exception to Statewide Planning Goal 15 Willamette River Greenway was approved for <br />Oregon Department of Transportation (ODOT) I-5 right of way crossing the Willamette River <br />and within the Willamette River Greenway Setback Line, for purpose of constructing a <br />temporary detour bridge, ~mplementing the conditions imposed on the Discretionary Use <br /> <br />Ordinance- 1 <br /> <br /> <br />
