Ordinance Exhibit DOrdinanceExhibitD DOWNTOWN RIVERFRONT LAND USE COMPONENTS CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 providing a more gradual bank condition with significantly enhanced riparian native plantings,views to the river's surface and riparian habitat conditions will be greatly improved.Key design features include: Extensive riparian habitat enhancement; Construction of a new bike path as a multi-modal pathway separating wheeled and pedestrian path users; Viewpoints reaching out over the river bank providing views up and down the river as it bends north; Integrated interpretive elements addressing themes of energy,ecology,industry and culture on the site; Vibrant landscape design and native planting landscapes; Public art; Site lighting,benches,and other park furniture; Programmable open space for markets,food carts,performance and other public events;and Play areas for families and children. As such,specific design goals for the park are tc Enhance riparian habitat conditions and develop visible stormwater treatment landscape connections within the new park. Significantly improve the section of the Ruth Bascom Riverfront Path and provide inclusive and easy access from downtown to the Riverfront and across the river at the Peter DeFazio Bridge. Create viewpoints that reach from the adjacent new development site out to river overlooks within the park. Integrate history and culture into the landscape via art-based interpretive element: Provide opportunities for activities,play,and programming within the park to encourage visitors from the community and around the world to experience and engage in the landscape of the river. Create a safe and inclusive park experience at any time of day or night for park visitors. As identified on the Adopted Protection Designations for the Eugene Goal 5 Wetland,Riparian,and Upland Wildlife Habitat Inventories Map dated November 14,2005,the Willamette River is categorized as a Category A Stream.All parcels within the subject site that abut the Willamette River have /WR Water Resource Conservation overlay zoning.Pursuant to EC 9.4920(l)(c)(l.),Category A streams with a distinguishable high bank have a 100 foot setback applied to top of bank (TOB)as part of the /WR overlay zoning.The Willamette River adjacent the development site features a distinguishable high bank.The existing high bank was surveyed by OBEC Consulting Engineers on June 13,2011 and is shown on Sheets S1.0 and Sl.l Existing Conditions Plans (Exhibit B.l)and labeled as "top of bank".Exhibit N:Wetland Delineation Report identifies jurisdiction wetland and waters boundaries along the Willamette River. Pursuant to EC 9.4920(5)(a)and (d),areas which the applicant has shown to be developed prior to November 14,2005,are excluded from /WR conservation areas.As demonstrated on Sheets R1.0 Regulatory Plan (Exhibit B.l),the subject site contains buildings on a concrete foundation,pursuant EC 9.4920(5)(a),as well as paved and gravel parking areas that serve administrative and operations uses in adjacent buildings,pursuant to EC 9.4920(5)(d),that were developed prior to November 14,2005; the date specified in EC 9.4920(5).Sheet R1.0 Regulatory Plan illustrates "/WR Prior Developed Areas"consistent with EC 9.4920(5);and,"/WR Conservation Areas"and "/WR Conservation Setback Areas."
