Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />As illustrated on Sheet R1.0 Regulatory Plan,3.24 acres within the /WR conservation setback are prior <br />developed in accordance with EC 9.4920(5)and are excluded from /WR conversation areas.The <br />standards and requirements at EC 9.4900 through EC 9.4980 do not apply to prior developed areas,as <br />specified in EC 9.3155(16),as amended. <br />The proposal involves two uses subject to Standards Review within /WR conservation areas in <br />accordance with EC 9.4930(3);specifically: <br />(b)Construction of public improvements (including but not limited to <br />streets,bridges,paved bikeways and pedestrian paths,and public <br />utilities)required by this land use code or specified in adopted plans. <br />Subject to EC 9.4980 /WR Water Resources Conservation Overlay Zone <br />Development Standards (1)through (11). <br />(f)Wetland or riparian area enhancement,restoration or creation <br />activities.Subject to EC 9.4980 /WR Water Resources conservation <br />Overlay Zone Development Standards (2)through (5). <br />The applicant has submitted a prior Standards Review application for Phase One of the Riverfront <br />Park,which includes uses in subsection (f)above,that is currently under review.14 This proposal <br />requests approval for uses pursuant to subsection (b),specifically construction of public <br />improvements. <br />Regarding Phase One,all of the riparian area enhancement work includes a laying back of the existing <br />steep bank in an approximately 500 linear foot section of the Willamette River;securing of the new <br />bank condition with fabric encapsulated stabilization methods;re-planting of the bank with a high <br />diversity of native trees,shrubs,and forbs;and relocation of two separate utility lines and associated <br />equipment for underground electrical service and high-speed fiber away from the existing top of bank. <br />Riparian enhancement work will occur over two seasons,2019 and 2020.Utility relocation work will <br />occur in the first season (2019)and is necessitated by the proposed bank enhancement work as the <br />existing utilities are located at a depth that will be exposed by the proposed bank layback. <br />The following findings demonstrate that the construction of public improvements,associated with <br />Phase Two of the Riverfront Park,complies with /WR development standards (1)through (11),as <br />specified in subsection (b)above. <br />EC 9.4980 /WR Water Resources Conservation Overlay Zone -Development Standards.The <br />following standards apply only as specifically required by EC 9.4930(3)or EC <br />9.8030(21): <br />(1)Enhancement.Where the /WR conservation area is reduced,or uses are <br />approved within the /WR conservation area,the remaining /WR <br />conservation area shall be enhanced consistent with this subsection and by <br />removing non-native plant species and planting native plant species <br />consistent with subsections (2)and (3)below. <br />14 SDR 19-001.Downtown Riverfront Park Standards Review Application.City of Eugene.May 19.2019. <br />City of Eugene FINAL SUBMITTAL 84July 17, 2019, Work Session – Item 2
