Ordinance Exhibit DOrdinanceExhibitD DOWNTOWN RIVERFRONT LAND USE COMPONENTS CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 Bridge Access Path Area Heavy equipment will be necessary to do the rough grading for the walks and new planting areas within the /WR conservation areas for this new path area.This rough grading will establish subgrades for paths,low retaining walls,and planting areas along this upland bank area.Additional heavy equipment may be needed to pour concrete and add soil,but these activities may occur via pumps or blowers from areas at the top of bank,outside of the conservation setback areas. Careful project planning,on-site haul route establishment and construction activity phasing and coordination will prioritize efficiencies and minimizing soil compaction within the /WR conservation areas as excavation and re-grading work is planned and implemented across the project site. Therefore,this standard is met. (b)Petroleum products,chemicals,or other deleterious materials used in the construction process shall not be allowed to enter a stream or wetland that is within a /WR conservation are; The contractor will be required under the construction contract with the City of Eugene to comply with all Erosion Prevention and Hazardous Materials requirements mandated by City Code while the site is under construction.These requirements will be made clear in the construction bid documents and associated contract language issued by the City and the construction contractor will be required to implement these measures under contract with the City. Perhaps more importantly,and as a result of the site's history as an industrial and operations property for the last 100 years,most areas of the Downtown Riverfront site are governed by an Oregon State Department of Environmental Quality mandated Contaminated Media Management Plan (CMMP).Soil toxins on the site are currently understood to be mostly low levels of petroleum contaminants which have been deemed unfit for approvable off-site clean fill.However,the DEQ has agreed that soils on site can be moved around within the site per the CMMP,which includes provisions for regular on-site inspections as the site is excavated and other worker safety provisions.All existing soil will,however, be capped with a minimum of 12"of imported top soil to assure long term plant health and minimize human contact with potentially contaminated native soils. As a result of this additional State-mandated site material management protocol,the limitations of work above the Willamette River ordinary high-water line,and City Code required erosion prevention permitting measures,the proposal will comply with the above standard. Therefore,this standard is met. (5)Filling,Grading and Excavating.Filling,grading and excavating within the /WR conservation area and within areas removed from the /WR conservation area shall comply with the following standards: (a)Filling,grading or excavating of more than 500 square feet must comply with Erosion Prevention regulations for sensitive areas in EC 6.645. The entire Riverfront Park development project will be governed by an Erosion Prevention Permit from the City.This permitting will occur using the provisions of the City's existing 1200C ECM permit with the State of Oregon.Erosion Prevention plans will be included in the contract bid documents and the requirements and practices established therein will be met on site by the construction contractor under contract with the City of Eugene.
