Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />properties relies upon on their existing .designations for parks and open space and nodal <br />development.These individual parcels were not included in the original re-zoning of properties to the <br />S-DR Zone as part of the "EWEB Riverfront Master Plan"(see Ord.20513 and its Exhibits)but have <br />since been recognized as additional parcels that should be rezoned as part of the new riverfront park <br />at its northern end near the DeFazio Pedestrian Bridge.It is also noted that these parcels will have a <br />subdistrict designation within the S-DR zone for /CL,Cultural Landscape,which is consistent with <br />their intended use and availability as part of the new riverfront park. They will also retain the /WR <br />Water Resource Overlay Zoning which will ensure compliance with the City's adopted protections for <br />Goal 5 resources (i.e.the Willamette River).None of these changes would conflict with any known, <br />adopted refinement plan provisions in the context of this criterion. <br />Regarding the removal of the /TD Transit Oriented Development Overlay Zone from one (1)parcel,the <br />development standards in the S-DR Zone (Exhibit A),as amended,duplicate the development <br />standards in the /TD Overlay Zone,with minor modifications to align with the redevelopment vision, <br />and are designed to achieve superior performance in development form.The provisions of the /TD <br />Overlay Zone are designed to supplant those of the applicable base zone or overlay zone.As the <br />provisions of the S-DR Zone duplicate and exceed the provisions of the /TD Overlay Zone,retention of <br />the /TD Overlay Zone would create inconsistencies and is therefore is no longer warranted. <br />Furthermore,this individual parcel is located well outside the Transit Oriented Development Overlay <br />Zone area as indicated on EC Map 9.4510,as are all the other parcels included as part of this <br />concurrent adoption package which were previously rezoned to S-DR and to remove the /TD Overlay <br />Zone in 2013 (again,see Ord.20513 and its Exhibits).In addition,there is no adopted refinement plan <br />that specifically requires retention of the /TD overlay in the context of this criterion.This action is <br />consistent with the overall intent of the S-DR Zone to still facilitate transit-oriented development as <br />part of the overall project,but with more specific provisions in the /CL subdistrict of the S-DR Zone <br />that will facilitate the riverfront park and natural resource protections along the Willamette River. <br />Based on the preceding findings,this criterion is satisfied. <br />(3)The uses and density that will be allowed by the proposed zoning in the <br />location of the proposed change can be served through the orderly extension <br />of key urban facilities and services. <br />The minimum level of key urban facilities and services are defined in the Metro Plan as including <br />wastewater service,stormwater service,transportation,solid waste management,water service,fire <br />and emergency medical services,police protection,City-wide parks and recreation programs,electric <br />service,land use controls,communication facilities,and public schools on a district-wide basis.11 All of <br />these key urban services and facilities are currently available or can be extended in an orderly and <br />efficient manner within a reasonable timeframe as needed,consistent with this criterion. <br />The subject property is located within the UGB and within the downtown core area of Eugene.The <br />subject parcels are currently developed and served by existing urban facilities and services.Future <br />redevelopment will necessitate extension of such services as is typical.Exhibit J:Stormwater Study <br />provides an evaluation of existing stormwater facilities within the subject property.Exhibit K: <br />Wastewater Study provides an evaluation of existing wastewater facilities within the subject property. <br />Existing transportation facilities are sufficient to handle the proposed re-zoning and subsequent <br />11 Lane Council of Governments (LCOG).Metro Plan.Glossary page V-3.2004 Update. <br />City of Eugene FINAL SUBMITTAL 46July 22, 2019, Work Session – Item 3
