Ordinance Exhibit DOrdinanceExhibitD DOWNTOWN RIVERFRONT LAND USE COMPONENTS CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 development as demonstrated by the findings of compliance with Statewide Planning Goals 11 and 12, under EC 9.8065(1).Other public services are available to properties within Eugene's UGB,including the subject parcels,and are available to serve them.Re-zoning subject parcels to S-DR and removing the /TD and /SR overlays will not affect the provision of key urban services. The proposal includes a concurrent request for Subdivision Tentative approval and the findings under EC 9.8515 are incorporated by reference herein as further demonstration of compliance with this criterion.Based on the preceding findings,this criterion is satisfied. (4)The proposed zone change is consistent with the applicable siting requirements set out for the specific zone in: *** (i)EC 9.3 140 S-DR Downtown Riverfront Special Area Zone Siting Requirements. * ** EC 9.3140 S-DR Downtown Riverfront Special Area Zone Siting Requirements.In addition to the approval criteria at EC 9.8865 Zone Change Approval Criteria,the site must be included within the Downtown Riverfront area depicted on Figure 9.3135 S-DR Zone Regulating Plan.The subdistrict and overlay subdistrict designations applicable to the property are shown on Figure 9.3135 S-DR Zone Regulating Plan and shall be more precisely located on individual lots upon land division approval. Exhibit A:Code Amendments includes an amended Figure 9.3185 S-DR Zone Regulating Plan which depicts all the of the parcels within the subject site,and subject to the re-zoning request as within the Downtown Riverfront area.Figure 9.3185 includes subdistrict and overlay subdistrict boundaries. Exhibit B.2:Tentative Subdivision Plan Set is a land division request for approximately 16-acres within the Downtown Riverfront area depicted on Figure 9.3185.The boundaries of subdistricts and overlay subdistricts are shown on Exhibit B.2:Tentative Subdivision Plan Set,in accordance with the above requirement.Based on the preceding findings,this criterion is satisfied. (5)In cases where the NRzone is applied based on EC 9.2510(3),the property owner shall enter into a contractual arrangement with the city to ensure the area is maintained as a natural resource area for a minimum of 50 years. The proposal does not involve the application of the /NR Zone.This criterion does not apply. Based on the preceding findings,the zone change is consistent with applicable approval criteria.
