Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />7.Trees with significant habitat value; <br />8.Trees adjacent to public parks,open space and streets. <br />9.Trees along water features. <br />10.Heritage trees. <br />The site was formerly developed with buildings,paved and gravel parking lots,and industrial <br />maintenance yards.Currently,there are no trees on the site.Also,the tentative subdivision will not <br />affect the street trees on East 4th Avenue or High Street.This criterion is not applicable. <br />(c)Restoration or Replacement. <br />For areas not included on the city's acknowledged Goal 5 <br />inventory,the proposal mitigates,to the greatest degree <br />attainable or feasible,the loss of significant natural features <br />described in criteria (a)and (b)above,through the restoration or <br />replacement of natural features such as: <br />1. <br />Planting of replacement trees within common areas;ora. <br />b.Re-vegetation of slopes,ridgelines,and stream corridors;or <br />Restoration of fish and wildlife habitat,native plant habitat, <br />wetland areas,and riparian vegetation. <br />c. <br />To the extent applicable,restoration or replacement shall be in <br />compliance with the planting and replacement standards of EC <br />6.320. <br />For areas included on the city's acknowledged Goal 5 inventory, <br />any loss of natural features shall be consistent with the <br />acknowledged level of protection provided for the resource. <br />2. <br />The site is not included on the City's acknowledged Goal 5 inventory.As stated in (a)and (b)above, <br />the natural features listed above did not exist on the site.Therefore,restoration or replacement is not <br />required.The subdivision will facilitate future site development.Trees are included in the <br />construction of streets,parks,plazas,and stormwater facilities.The end result will be a significant <br />increase in landscape materials on the site today.Based on the above findings,this criterion is met. <br />(d)Street T rees.If the proposal includes removal of any street tree(s), <br />removal of those street tree(s)has been approved,or approved with <br />conditions according to the process at EC 6.305 of this code. <br />There are street trees on East 4th Avenue and High Street planted adjacent to the subject site.The <br />tentative subdivision does not propose removal of the street trees.This criterion is not applicable. <br />(8)On R-l zoned property,if the subdivision results in a lot greater than 13,500 <br />square feet in size based on EC 9.2761(5)(b),the application shall indicate <br />the location of lot lines and other details of layout that show future division of <br />the lot may be made without violating the requirements of this land use code <br />City of Eugene FINAL SUBMITTAL 71July 22, 2019, Work Session – Item 3
