Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />established by the 100-foot /WR conservation setback in EC 9.4920(l)(c)(l.)or affect inventoried <br />Goal 5 Water Resources. <br />Pursuant to EC 9.4920(5)(a)and (d),areas which the applicant has shown to be developed prior to <br />November 14,2005,are excluded from /WR conservation areas.As demonstrated on Sheets R1.0 <br />Regulatory Plan (Exhibit B.l),the subject site contains buildings on a concrete foundation,pursuant EC <br />9.4920(5)(a),as well as paved and gravel parking areas that serve administrative and operations uses <br />in adjacent buildings,pursuant to EC 9.4920(5)(d),that were developed prior to November 14,2005; <br />the date specified in EC 9.4920(5).Sheet R1.0 Regulatory Plan illustrates "/WR Prior Developed <br />Areas"consistent with EC 9.4920(5);and,"/WR Conservation Areas"and "/WR Conservation Setback <br />Areas." <br />The proposed amendments do not affect established protections.These areas will remain subject to <br />the provisions of the /WR overlay zone.Through the applicant's concurrent zone change request to <br />implement the proposed zoning designations,the existing /WR overlay zoning will remain applicable. <br />Protection of this Goal 5 resource will therefore remain the same;regardless of the proposed <br />amendments. <br />Scenic and Historic Areas <br />The Eugene Goal 5 Water Resource Conservation Plan and the Goal 5 Inventory and Metro Natural <br />Assets &Constraints Working Papers,specifically the Scenic Site Working Paper and the Archeological <br />Sites Working Paper,do not identify any scenic or historic resources on the subject site.None of the <br />buildings located on the subject site are listed as City of Eugene Historic Landmarks nor are they listed <br />in the National Register of Historic Places.Based on these findings,there are no inventoried Goal 5 <br />historic resources or listed historic resources on the subject site. <br />Oregon Revised Statute (ORS)358.653 obligates state agencies and political subdivisions of the state <br />to consult with the State Historic Preservation Office (SHPO)to avoid inadvertent impacts to historic <br />properties for which they are responsible,including those resources listed and eligible to be listed on <br />the National Register of Historic Places.The statute does not provide specific standards or criteria,so, <br />as a practical matter,any project that involves a property that meets the 50-year guideline at the time <br />of construction must be reviewed through SHPO consultation.Projects which trigger review include <br />significant alterations,additions,demolition while maintenance activities are generally exempt.The <br />statute also applies if an agency is selling or transferring property out of public ownership. <br />In 2011,EWEB commenced a process of decommissioning surplus facilities on its riverfront <br />headquarters site.In accordance with ORS 358.653,EWEB submitted clearance forms for three <br />buildings on the site: <br />The Vehicle Repair Shop (1949):Determined likely Not Eligible for Listing in the National <br />Register <br />The Warehouse/Operations Building (1952):Determined Eligible for Listing in the National <br />Register <br />The Steam Plant Pump House (1931):Determined Eligible for Listing in the National Register <br />(Adverse Effect) <br />Standby Steam Plant (Steam Plant)(1931):Determined to be historically significant and <br />Eligible for Listing on the National Register of Historic Places <br />On December 12,2011,SHPO signed a Memorandum of Agreement (MOA)with EWEB to mitigate for <br />adverse effects associated with the decommissioning including demolition of the Steam Plant Pump <br />House. <br />City of Eugene FINAL SUBMITTAL 18July 22, 2019, Work Session – Item 3
