Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />In 2013,in an effort to attract potential buyers of the property,EWEB pursued a hazardous substance <br />abatement project.EWEB and SHPO executed a memorandum of agreement related to EWEB's <br />Standby Steam Plant.The MOA was generated to provide mitigation measures related to removal of <br />asbestos-containing materials. <br />In 2018,in response to Riverfront Master Plan changes,City of Eugene Facilities staff submitted SHPO <br />clearance forms for the Equipment Repair Building and Midgley Mill Building.SHPO staff concurred <br />with City staff: <br />The Equipment Repair Shop (1988):Determined Not Eligible for Listing in the National <br />Register <br />The Midgley Building (1922):Determined Not Eligible for Listing in the National Register <br />In 2019,also in response to changes to the Riverfront Master Plan calling for the demolition of the <br />EWEB Headquarters Warehouse and Operations Building,the City of Eugene submitted the required <br />SHPO Clearance Form.SHPO staff once again concurred with City staff: <br />The Warehouse and Operations Building (1988):Determined Eligible for Listing in the <br />National Register <br />SHPO also concurred that the proposed undertaking (demolition)would result in adverse effect to <br />historic properties.In order to mitigate the adverse effect,the City of Eugene executed a MOA between <br />the City and SHPO.Through the consultation process with SHPO,the City ultimately agreed to <br />stipulations required to undertake the proposed demolition.The stipulations include documenting the <br />building,architectural history research,on-site interpretation installation,and digital archiving of <br />documentation. <br />Throughout the consultation process,SHPO staff has indicated that the Riverfront Project Area lies <br />within an area generally perceived to have the potential for possessing archaeological resources. <br />Under state law (ORS 358.905 and ORS 97.74)archaeological site,objects,and human remains are <br />protected on both public and private lands in Oregon.SHPO recommends consulting with all <br />appropriate Indian tribes.An Inadvertent Discovery Plan is also recommended to be put in place to <br />provide guidance should construction result in the discovery of archaeological objects or sites. <br />Concerning pre-historic and historical resources,Riverfront Master Plan planning activities continue <br />to follow processes outlined by City Code and State law.Staff will continue ongoing SHPO consultation <br />as necessary. <br />Open Spaces <br />The Eugene Goal 5 Water Resource Conservation Plan and the Goal 5 Inventory and Metro Natural <br />Assets &Constraints Working Papers do not identify any open spaces on the subject site. <br />The proposal includes a new Riverfront Park on the subject site,as identified in the 2018 Eugene Parks <br />and Recreation System Plan,a 30-year strategic plan.A proposed Riverfront Park on the subject site is <br />identified as Project #C1 "Downtown Riverfront Park development at former EWEB site to serve [the <br />City Central Neighborhood Planning area]"in Appendix A Planning District Summaries and <br />City of Eugene FINAL SUBMITTAL 19July 22, 2019, Work Session – Item 3
