Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />downtown area.Therefore,the proposed amendments are consistent with Statewide Planning Goal <br />13. <br />Goal 14 -Urbanization:To provide and orderly and efficient transition from rural to <br />urban land use,to accommodate urban population and urban employment inside <br />urban growth boundaries,and to provide for livable communities. <br />The proposed amendments are site specific to land already subject to urban uses and do not affect the <br />transition from rural to urban land use,as the entirety of subject property is within the City limits. <br />Therefore,the proposed amendments and zone change are consistent with Statewide Planning Goal <br />14. <br />Goal 15 -Willamette River Greenway:to protect,conserve,enhance and maintain the <br />natural scenic,historical agricultural economic,and recreational qualities of lands <br />along the Willamette River as the Willamette River Greenwav. <br />Goal 15 aims to protect,conserve,enhance,and maintain the natural scenic,historical,agricultural, <br />economic,and recreational qualities of lands along the Willamette River.As illustrated on Sheet R1.0 <br />Regulatory Plan (Exhibit B.l),19.75 acres of the subject site are located within the Willamette River <br />Greenway.The proposal involves a concurrent request for approval of a Willamette Greenway permit <br />to allow development envisioned by the Downtown Riverfront Concept Plan. <br />As illustrated on Sheets L1.0 and Ll.l Site Plan (Exhibit B.l),the proposal involves the establishment <br />of a Willamette Greenway setback line to keep structures separated from the river and to protect, <br />maintain,preserve,and enhance the natural,scenic,historic,and recreational qualities of the <br />Willamette Greenway.The proposed setback line is site specific,context sensitive,and responds to <br />existing conditions and the redevelopment vision.The proposed Greenway setback varies in width <br />from 25 feet to 125 feet adjacent the Willamette River,as delineated from the top-of-bank.The <br />setback's variable width responds to existing site conditions and anticipated redevelopment consistent <br />with the Downtown Riverfront Concept Plan vision.In total the proposed Willamette Greenway <br />Setback will protect 3.67 acres of the subject site.Adoption of the setback ensures that only park- <br />related development will be allowed between the setback and the river,that adequate public access is <br />provided along the river frontage,that limited existing habitat is protected,and that the remaining <br />natural vegetative fringe is protected. <br />The findings under EC 9.8815 demonstrate compliance with applicable approval criteria and <br />standards for proposed development within Willamette Greenway.Compliance with applicable Metro <br />Plan Willamette Greenway Policies is demonstrated in the findings for EC 9.8065(2)below.Based on <br />these findings,and incorporated by reference herein,the proposed amendments are compliant with <br />Statewide Planning Goal 15. <br />Goal 16-19 -Estuarine Resources.Coastal Shoreland.Beaches and Dune,and Ocean <br />Resources: <br />There are no estuarine,coastal,ocean,or beach and dune resources on the subject property or <br />otherwise affected by the proposed amendments and zone change.Therefore,Statewide Planning <br />Goals 16 through 19 do not apply. <br />The preceding findings demonstrate that the proposed amendments (and zone change)are consistent <br />with all relevant Statewide Planning Goals.Based on these findings,EC 9.8065(1)is satisfied. <br />City of Eugene FINAL SUBMITTAL 26July 22, 2019, Work Session – Item 3
