Ordinance Exhibit DOrdinanceExhibitD
DOWNTOWN RIVERFRONT
LAND USE COMPONENTS
CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019
(b)The local government has an acknowledged TSP and the proposed
zoning is consistent with the TSP;and
(c)The area subject to the amendment was not exempted from this rule at
the time of an urban growth boundary amendment as permitted in OAR
660-024-220(l)(d),or the area was exempted from this rule but the
local government has a subsequently acknowledged TSP amendment
that accounted for urbanization of the area.
The 2035 TSP is the City's acknowledged local transportation system plan.Chapter 3:Needs
Assessment and Evaluation of the 2035 TSP provides:
The needs assessment and resulting projects...that establish a transportation system adequate to
meet the identified local transportation needs are based upon the land use designations
established by the Metro Plan.Because the 2035 TSP is based on the Metro Plan land use
designations, any zone allowed within the land use designation is consistent with both the Metro
Plan and this 2035 TSP.
As previously discussed, and detailed in the related Zone Change findings, incorporated by reference
herein, the recommended zoning of (8)parcels within the subject property from S-W,1-2,and PL to S
DR is consistent with the land use designations in the Metro Plan. Therefore, the proposed zone
change is consistent with the 2035 TSP.
Because the proposal does not involve amendments to the Metro Plan (or any Refinement Plan)
designations, and the proposed S-DR zoning remains consistent with the existing Mixed Use and Parks
and Open Space designations, the zone change complies with OAR 660-012-0060(9)and satisfies OAR
660-012-0060(1).
The /ND Nodal Development Metro Plan overlay designation has also been applied to the entire
Downtown Plan area. This designation identifies the Downtown Plan area as a nodal development,
transit-oriented/pedestrian district,in further compliance with Statewide Planning Goal 12.Well-
designed mixed-use developments at higher densities which encourage transit use are particularly
desired in this area. The proposed amendments and zone change do not affect the /ND designation,as
implemented through the S-DR zoning.
Based on these findings, the proposed amendments and zone change comply with the Transportation
Planning Rule. Therefore, the proposed amendments and zone change are consistent with Statewide
Planning Goal 12.
Goal 13 -Energy Conservation:To conserve energy.
Goal 13 requires that land and uses developed on the land shall be managed and controlled so as to
maximize the conservation of all forms of energy, based upon sound economic principles.Goal 13 is
directed at the development of local energy policies and implementing provisions and does not
establish any requirements with respect to other types of land use decisions. To the extent that Goal
13 could be applied to the proposed amendments and zone change, the existing and proposed
designations are consistent with statewide planning Goal 13.
The proposed amendments and zone change do not specifically impact local energy conservation
policies or implementing provisions, except to encourage compact urban development within the
City of Eugene 25FINALSUBMITTALJuly 22, 2019, Work Session – Item 3
