The pla.nning commission shall review the <br />application and receive pertinent evidence and testimony as to why or how the <br />proposed annexation is consistent with the following criteria: <br />(1) The property is inside the urban growth boundary and annexation would be <br />consistent with adopted plans and policies. <br />(2) Public services and facUities can be provided as prescribed in the Metro Plan <br />or applicable refinement plans. <br />(3) Annexation win result in a boundary in which services can be provided in an <br />orderly, efficient, and timely manner. <br />(Section 9.7835, see chart at front of Chapter 9 for legislative history from 2/26/01 through 611/02.) <br /> <br />9.7840 Criteria of Approval for Chanaesin Zo.ne Concurrent with Annexations. To <br />maintain consistency between zoning and applicable plans and studies, the <br />planning commission may also recommend zone changes for the city council. to <br />consider in conjunction with annexation applications. The planning commission shall <br />review the application and receive pertinent evidence and testimony as to why or <br />how. the proposed change in zone concurrent with an annexation is consistent with <br />the following criteria: <br />(1) The proposed change is consistent with the Metro . Plan . The written text of <br />the Metro Plan shan take precedence over the Metro Plan diagram where <br />apparent conflicts or inconsistencies exist. <br />(2) The proposed zone change is consistent with applicable adopted refinement <br />plans. In the event of inconsistencies between these plans and the Metro <br />Plan, the Metro Plan is the prevailing. document. <br />(3) The uses and density that will be allowed by the proposed ,zone in the location <br />of the proposed change can be served through the orderly extension of key <br />urban facilities and services. <br />(Section 9. 7840, see ohart at front of Chapter 9 for legislative history from 2/26/01 through 6/1/02.) <br /> <br />9.7845 Plannina Commission. Decision. Unless the applicant agrees to a postponement, <br />within 15 days following the close of the record, the planning commission. shall. deny <br />the application or recommend approval to the city council. A recommendation of <br />approval may include modifications. to the original annexation application. If <br />necess.ary, the planning commission shall recommend approval, approval with <br />modifications, or denial of a concurrent change in zoning to the city council.
