Ordinance Exhibit D <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1, RA 19-1, Z 19-5, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019 <br />Residential/ Mixed Use Area, and the area beneath and east of the viaduct is designated Mixed Use <br />Area. The entire site area is designated with a Nodal Development Area overlay. The area east of the <br />viaduct is also within the Willamette Greenway. <br />The Metro Plan defines the High Density Residential (HDR) designation as areas of predominantly <br />residential use that are developed at a density of more than 20 dwellings units per gross acre. <br />The Mixed Uses designation identifies "areas where more than one use might be appropriate, usually <br />as determined by refinement plans on a local level." The EWEB Downtown Riverfront Specific Area <br />Plan, which is being repealed as part of the comprehensive application package, provided such <br />direction and it was subsequently adopted as the S -DR code standards. The Metro Plan notes that "[i]n <br />the absence of a refinement plan, the underlying plan designation shall determine the predominant <br />land use." The Specific Area Plan recognized that the area is appropriate for a mixture of uses, thereby <br />broadening the potential development options in the area designated for HDR. <br />The Nodal Development Area Overlay is intended to create "a mixed-use pedestrian -friendly land use <br />pattern that seeks to increase concentrations of population and employment in well-defined areas <br />with good transit service, a mix of diverse and compatible land uses, and public and private <br />improvements designed to be pedestrian and transit oriented." <br />The subdivision creates lots that enable development that is consistent with the plan designation and <br />overlays, as described above. <br />There are five adopted Metro Plan policies at EC 9.9560, however only Policy (5) is potentially relevant <br />to the subject proposal: <br />(5) Environmental Design Element. Natural vegetation, natural water features, and <br />drainage ways shall be protected and retained to the maximum extent <br />practicable, considering the economic, social, environmental, and energy <br />consequences in the design and construction of urban developments. Landscaping <br />shall be utilized to enhance distinctive natural features. (Policy Z page III -E-3) <br />The Metro Plan policies are largely directed at the City for purposes of legislative actions and are not <br />intended to be approval criteria for development proposals. The City of Eugene has implemented this <br />policy guidance through the inventory and analysis of Goal 5 Resources, as well as the adoption of the <br />/WR Water Resources Conservation Overlay zone. The site is subject to both and each is addressed <br />herein. <br />It is worth noting that the site (specifically, the land area within the tentative subdivision plat) does <br />not include any significant natural vegetation, water features, or drainage ways. As described in the <br />findings associated with (1)(a), above, the site is developed with buildings and paved or gravel parking <br />areas. The larger area subject to the S -DR zone includes such features, including the Willamette River <br />riparian corridor, in the publicly owned riverfront park. The details of the proposed park <br />development and riparian enhancements (e.g., removal of select rock rip -rap, restored native <br />plantings, re-contoured river bank) are included in the separate Standards Review land use <br />application. <br />EC 9.9500 Adopted Plan Policies. The adopted plan policies set forth in the sections beginning <br />at EC 9.9500 shall be used when applicable for purposes of evaluating applicable <br />adopted plan policies pertaining to subdivisions, partitions, and site review. <br />City of Eugene FINAL SUBMITTAL 67 <br />
