Ordinance Exhibit D
DOWNTOWN RIVERFRONT
LAND USE COMPONENTS
CA 19-1, RA 19-1, Z 19-5, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019
Furthermore, the discussion in EC 9.6791(3)(b) demonstrates stormwater runoff from the
development site is directed to the Willamette River through established man-made flood control
facilities and outfalls. Stormwater from the development site is not directed to facilities under the
jurisdiction of the Junction City Water Control District. Therefore, this standard is not applicable.
(4) Underground Injection Control Systems. Stormwater runoff discharged in
underground systems is also regulated through the federal Underground
Injection Control (UIC) program under Part C of the Safe Drinking Water Act
(42 U.S.C. § 300, Chapter 6A, Subchapter XII) and Oregon Administrative Rule
Chapter 340, Section 044.
This standard acknowledges that UIC's are not directly regulated by the NPDES MS4 permit and the
City of Eugene beyond the verification of flood control standards identified in EC 9.6791(3) (a) and (b)
of this code. UIC's have applicable statutes and regulation under the jurisdiction of the Oregon
Department of Environmental Quality (ODEQ) and require additional permitting directly through a
state agency. The development proposes to discharge all stormwater runoff into existing conveyances
that outfall to established surface waters not under the jurisdiction of UIC regulations. No UIC's are
proposed with this development. Therefore, the standards of EC 9.6791(4) are not applicable. Any
UIC proposed with a future development permit shall be subject the standard of EC 9.6791(4) and the
time of development permit application.
EC 9.6792 Stormwater Quality.
(2) Applicability and Exemptions.
(f) The standards in EC 9.6792 (3) do not apply to land use applications or
development permit applications within the S -DR Downtown Riverfront
Special Area Zone. Instead, the standards at EC 9.3155(17) apply.
The standards at EC 9.6792 for Stormwater Quality do not apply to land use applications or
development permit applications within the S -DR Downtown Riverfront Special Area Zone. This
development is fully within the S -DR Downtown Riverfront Special Area Zone, so the standard at EC
9.3155(17) applies instead. The following includes findings demonstrating consistency with the
standards of the S -DR Downtown Riverfront Special Area Zone.
EC 9.3155 S -DR Downtown Riverfront Special Area Zone General Development Standards
(applicable to all property).
(17) Stormwater Quality Control Standards. The Stormwater Quality Control
standards at EC 9.6792 (3) are not applicable in the S -DR Zone. The following
standards apply, instead.
(a) For land use applications proposing the construction of a public or
private street, stormwater facilities shall be selected from the
Stormwater Management Manual and may be sized to also treat some or
all the stormwater runoff from future development on lots adjoining the
street.
City of Eugene FINAL SUBMITTAL 76
