Ordinance Exhibit D
DOWNTOWN RIVERFRONT
LAND USE COMPONENTS
CA 19-1, RA 19-1, Z 19-5, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019
This standard requires the construction of water quality facilities in conformance with the Stormwater
Management Manual for land use applications proposing the construction of a public or private street.
The development is proposing the construction of public streets to serve the development site.
Stormwater facilities have been selected from the Stormwater Management Manual to treat all
impervious surfaces in the proposed public streets. The stormwater treatment plans shown on sheets
C7.0 and C7.1 of the application show the conceptual location of the water quality facilities. The
stormwater memo from KPFF, dated March 2019 (see Exhibit J) calculates the runoff from the
required water quality design storms and calculates the required treatment area. The development
has also proposed to oversize the treatment facilities to accommodate the stormwater runoff from
future lots on adjoining streets. The development has proposed to capture and treat stormwater
runoff from the existing Ferry Street viaduct to be used as an equivalent on-site treatment area, as
allowed by the Stormwater Management Manual, for hydraulically isolated areas and future buildings
with zero lot line construction where a traditional vegetated water quality facility is difficult or
impossible to implement. The technique also allows the development to capture and treat existing
high pollutant runoff that would otherwise be discharged to the Willamette River untreated. This
better meets the City's permit requirements consistent with the intent of this standard. The specific
design and size of the facilities will be further refined in the public improvement design process. The
potential treatment capacity will be made available to adjoining lots, to potentially be utilized under
agreement as allowed in EC 9.3155(17), and will be documented as a part of the public improvement
process. Therefore, this standard is met.
(b) Applications for a development permit shall comply with (17) (c) at the
time of development permit application unless the applicant has
entered into an agreement with the City of Eugene demonstrating that a
stormwater facility approved pursuant to (a) will treat all of the
stormwater runoff from the development being proposed by the
applicant.
The proposed tentative subdivision is a land use application and does not include any associated
development permits. Therefore, this standard does not apply to the tentative subdivision. Future
development of buildings and other site improvements on individual lots created by the subdivision
will need to conform to the standard at the time of permits.
(c) An application for a development permit that is not exempt under (b),
including an application pertaining to a development that is subject to
an agreement with the City of Eugene demonstrating that a stormwater
facility approved pursuant to (a) will treat some, but not all, of the
stormwater runoff from the proposed development:
1. Shall include stormwater quality facilities selected from the
Stormwater Management Manual based on the following priority
order: infiltration, filtration, off-site stormwater quality
management.
2. If selecting a filtration treatment facility, shall include a report
that demonstrates at least one of the following development site
conditions exist:
a. Infiltration rates are less than 2 inches per hour;
City of Eugene FINAL SUBMITTAL 77
