Ordinance Exhibit D <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1, RA 19-1, Z 19-5, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019 <br />Existing vegetation in this area is predominantly shrubby and in poor to very poor condition. While <br />this area is one that is maintained by City of Eugene Parks and Open Space Operations staff, low <br />funding and staffing levels have made this area a significantly lower priority than other more visible <br />park assets. It is unirrigated, is often overgrown, and isn't manicured or welcoming in any way. <br />Homeless camping and other illicit activities are frequent in this area as well. As a result, Blackberry, <br />Ivy and other non-native weedy species are present in the area along with some native trees scheduled <br />for preservation. <br />Removal of this vegetation and the subsequent regrading work will make way for a significant public <br />path improvement for pedestrians, as well as a much healthier and well -cared for native landscape <br />area surrounding this new pathway. <br />No additional vegetation removal is scheduled for any other areas of the park development site in this <br />phase of work. <br />Therefore, this standard is met. <br />(b) Clearing of more than 500 square feet of vegetation must comply with <br />Erosion Prevention regulations for sensitive areas in EC 6.645. <br />The entire Riverfront Park development project will be governed by an Erosion Prevention Permit <br />from the City. This permitting will occur using the provisions of the City's existing 1200C ECM permit <br />with the State of Oregon. Erosion Prevention plans will be included in the contract bid documents and <br />the requirements and practices established therein will be met on site by the construction contractor <br />under contract with the City of Eugene. <br />Therefore, this standard is met. <br />(c) Any clearing of vegetation that is not within the footprint of uses <br />approved in accordance with EC 9.4930(3)(a) through EC 9.4930(3)(k), <br />or uses approved through an adjustment approved under EC <br />9.8030(2 1), must be followed by replanting in accordance with the <br />requirements of subsection (3) below. <br />All disturbed areas will be over -seeded or replanted with native species, or prior to the beginning of <br />the rainy season per Erosion Prevention Permit requirements. All areas scheduled for permanent <br />replanting will be planted with shrubs, trees and forbs in compliance with requirements of subsection <br />(3) below prior to final completion of the project. <br />Therefore, this standard is met. <br />(3) Planting and Replanting. Planting or replanting within the /WR conservation <br />area shall comply with the following standards: <br />(a) Areas of existing bare soil and areas which have been cleared or graded <br />in accordance with subsection EC 9.4980(2) or EC 9.4980(5) shall be <br />planted with native plant species. Except as required in (b) and (c) <br />below, plant species and plant spacing used for such plantings shall be <br />appropriate to increasing to the greatest extent practicable the capacity <br />of the conservation setback area to filter pollutants from runoff that <br />flows across the conservation setback area (not including stormwater <br />City of Eugene FINAL SUBMITTAL 88 <br />
