ATTACHMENT A ORDINANCE NO. ___________ AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD PARK AND RECREATION DISTRICT, AND FROM THE SANTA CLARA WATER DISTRICT. (CB #4939) The City Council of the City of Eugene finds that: A. Resolution No. 4901, adopted on January 22, 2007, proposed withdrawal from the River Road Water District and the River Road Park and Recreation District, and from the Santa Clara Water District (“the Districts”), the parts of the Districts annexed to the City as described in Exhibit A attached to that Resolution. B. The Resolution set February 20, 2007, at 7:30 p.m., in the Council Chambers, City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals, and directed that notice of the time and place of the hearing be published once each week for two successive weeks prior to the hearing and that the notice be posted in four public places in the City for the same period. The Notice has been so published in the Register Guard and posted in four public places in the City of Eugene, Oregon. C. The City is willing to assume the liabilities and indebtedness previously contracted by the Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective date of the withdrawals. D. The withdrawals of the annexed territories from the Districts are consistent with the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area General Plan, and other adopted City policies, and it is in the best interest of the City that the territories be withdrawn. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The following territory in Lane County, Oregon, annexed to the City of Eugene on May 17, 2006, by Notice of the Lane County Local Boundary Commission approved on March 24, 2006, is withdrawn from the River Road Water District and River Road Park and Recreation District, effective July 1, 2007: Tax Lots 3600, 3700, and 3800, Assessor's Map 17-04-14-23, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, north of Boyce Street, west of Park Avenue, southwest of Armstrong Avenue, east of Bushnell Lane, and more particularly described on Exhibit 1 attached hereto and incorporated herein by reference.
