3. Application Contents <br />The information requirements for an annexation application are stated at EC 9.7810(1) through <br />10). The application form page 2 lists all the required information. That information has been <br />compiled here, as reflected in the check boxes on the application form. <br />4. Criteria for approval of annexation application: <br />EC 9.7825 provides the primary criteria applicable to an annexation application. This code <br />section refers to additional criteria (such as applicable Metro Plan policies) that will need to be <br />addressed as well. <br />EC 9.7825 Annexation -Approval Criteria. The city council shall approve, <br />modify and approve, or deny a proposed annexation based on the application's <br />consistency with the following: <br />7) The land proposed to be annexed is within the city's urban growth <br />boundary and is: <br />a) Contiguous to the city limits; or <br />b) Separated from the city only by a public right of way or a stream, bay, <br />lake or other body of water. <br />Applicant's proposed finding: The subject property is within the city's UGB. The subject <br />property is directly contiguous with the current city limits along the approximate 70 foot length <br />of the portion of it's western boundary that is contiguous with the eastern boundary of Land <br />Partition Plat No. 2004-P1838. <br />2) The proposed annexation is consistent with applicable policies in the <br />Metro Plan and in any applicable refinement plans. " <br />Applicant's proposed finding: The Metro Plan Policy 9, page 11-B-5, recognizes <br />annexations through this normal process to be the highest priority. As such, the proposal <br />is consistent with this policy <br />Metro Plan Policy 8, page 11-B-4, provides for annexation when a minimum level <br />of key facilities and services can be provided. This policy is the subject of the annexation <br />standard in (3) below. <br />Metro Plan Policy 15 provides that land within the UGB shall be annexed to a city <br />and provided with the minimum level of urban facilities and services. It further provides <br />that while the timeframe for annexation may vary, annexation should occur as land <br />transitions from urbanizable to urban. The property is within the UGB and therefore, <br />based on this policy, should be annexed. The provision of facilities and services is <br />addressed in standard (3) below. The property is designated LDR on the Metro Plan. The <br />property is currently zoned R-1 which is consistent with the low density residential <br />designation assigned to the site in the Metro Plan. <br />September 9, 2019, Meeting – Item 2C
