<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Work Session: An Ordinance Concerning Public Improvements <br /> <br /> <br />Meeting Date: June 27, 2007 Agenda Item Number: B <br />Department: Public Works Staff Contact: Peggy Keppler <br />www.eugene-or.gov Contact Telephone Number: 682-2869 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />The purpose of this work session is to present the ordinance for revisions to Eugene Code Chapter 7 <br />Public Improvements to Council (Attachment A: Draft Ordinance) in preparation for the public <br />hearing scheduled for July 16, 2007. <br /> <br /> <br />BACKGROUND <br /> <br />The proposed code amendments are intended to bring Chapter 7 in line with the rest of the code. <br />Several changes in other chapters of the Eugene code and new work programs, such as the erosion <br />prevention program and the stormwater development standards, along with state and federal <br />legislative changes were implemented into City operations and procedures but not adequately <br />incorporated into Chapter 7. The proposed code amendments will document consistency between <br />regulations and operations. <br /> <br />Proposed Changes <br />Definitions: Definitions located throughout the chapter were consolidated into one location, <br />? <br /> <br />unused terminology was removed, and other definitions were updated to match other chapters <br />within the code. <br />Standard Specifications and Design Standards: With the adoption of stormwater development <br />? <br /> <br />standards in 2006, residential development proposals may now elect to have the City maintain the <br />required water quality facilities; as such, it was necessary to add language to include City <br />maintenance of private stormwater facilities as a requirement for designing and constructing those <br />private facilities under the same standard specifications and design standards as public facilities. <br />Temporary Work: A new section was added to the chapter to define and describe temporary <br />? <br /> <br />work requirements. <br />Construction of Public Improvements: Clarification on the requirements of obtaining a permit for <br />? <br /> <br />construction public improvements, paying associated City costs, and the bonding requirements for <br />privately engineered and constructed improvements are incorporated into the code. <br />Local Improvements: Clarifications on processing and assessing local improvements for <br />? <br /> <br />publicly engineered and constructed public improvements were also incorporated into the code. <br />Construction and Use of the Public Way: Several clarifications to the permitting management <br />? <br /> <br />of the public way were made to the chapter. <br />Public Easement Requirements: A new section was added to the chapter to clarify the purpose <br />? <br /> <br />and use of public utility easements. <br />Sidewalks: Several changes to the sidewalk requirements were made to the chapter to <br />? <br /> <br />strengthen the expansion and accessibility of public sidewalks throughout the city. <br /> L:\CMO\2007 Council Agendas\M070627\S070627B.doc <br /> <br />
