<br />FIFTH EXTENSION OF THE MARCH 17, 2020, DECLARATION OF A
<br />STATE OF EMERGENCY UNDER SECTION 2.1055 OF THE EUGENE
<br />CODE, 1971 WITHIN THE CITY OF EUGENE, OREGON, DUE TO THE
<br />COVID-19 PANDEMIC.
<br />The City Manager Pro Tern of the City of Eugene finds that:
<br />A. Section 2.1055 of the Eugene Code, 1971, provides that the City Manager may
<br />declare a state of emergency when an emergency requires a coordinated response beyond that
<br />which occurs routinely, the required response is not achievable solely with the added resources
<br />acquired through mutual aid or cooperative assistance agreements, and the emergency consists of
<br />a Level 3 emergency under the city's emergency management plan.
<br />B. Following a special meeting of the City Council during which the City Council
<br />unanimously passed a motion supporting the City Manager Pro Tern declaring a state of emergency
<br />due to the COVID-19 pandemic, on March 17, 2020, at 1:04 p.rn., the City Manager Pro Tern
<br />executed Administrative Order No. 21-20-03 declaring a state of emergency under Section 2.1055
<br />of the Eugene Code within the City of Eugene due to the COVID-19 pandemic.
<br />C. On March 23, 2020, Governor Kate Brown issued Executive Order No. 20-12
<br />("Stay Horne, Save Lives"), ordering Oregonians to stay at home, closing specified retail
<br />businesses, requiring social distancing measures for other public and private facilities, and
<br />imposing requirements for outdoor areas and licensed childcare facilities. On March 27, 2020, the
<br />City Manager Pro Tern executed Administrative Order No. 21-20-04 extending the March 17,
<br />2020 , emergency declaration until April 14, 2020. On April 13, 2020, City Manager Pro Tern
<br />executed Administrative Order No. 21-20-05 extending the March 17, 2020, emergency
<br />declaration until April 28, 2020. On April 27, 2020, City Manager Pro Tern executed
<br />Administrative Order No. 21-20-06 extending the March 17, 2020, emergency declaration until
<br />May 12, 2020. On May 11, 2020, City Manager Pro Tern executed Administrative Order No. 21-
<br />20-07 extending the March 17, 2020, emergency declaration until May 26, 2020.
<br />D. On May 1, 2020, Governor Brown found that COVID-19 continues to threaten
<br />public health and safety, and remains a statewide emergency under ORS 401.025 and, therefore,
<br />she extended the statewide emergency that she had declared on March 8, 2020 (that was set to
<br />expire on May 7, 2020) for an additional 60 days, through July 6, 2020. The Lane County
<br />Emergency Declaration, adopted onMarch 17, 2020, has been extended by the Lane County Board
<br />of Commissioners until July 15, 2020 . The City of Springfield's Emergency Declaration, initially
<br />set to expire on May 12, 2020, has been extended indefinitely. For a number of reasons, the
<br />Emergency Managers for Eugene, Springfield, and Lane County recommend that each
<br />jurisdiction's emergency declarations remain in place until Lane County has completed Governor
<br />Brown's Phase II, plus an additional two weeks.
