The Springfield Commercial and Buildable <br />Lands Inventory does not consider constrained land as part of the UGB expansion. <br />Wetlands, floodways, slopes greater than 15 percent, and riparian areas will not be <br />included as a possibility for development. However, though considered constrained, <br />development can occur in the floodplain, the Willamette River Greenway, and BPA <br />Easements. <br />Regarding new development in areas prone to natural hazards, the Oregon land use <br />program explicitly prohibits or restricts development in said areas. With statutory <br />authority granted under Oregon Revised Statute Chapter 197, Oregon Administrative <br />Rules provide for needed housing that is, "...suitable, available and necessary for <br />residential uses." Land that, "(a) [i]s severely constrained by natural hazards as <br />determined under Statewide Planning Goal 7," ..(c) [h]as slopes of 25 percent or <br />greater," or "(d) [i]s within the 100-year floodplain," are not considered "suitable and <br />available" under the buildable land definition.7 In practice, development is either <br />prohibited or restricted through development regulations. While the process of UGB <br />expansion is ongoing in Eugene and Springfield, the proposed expansion sites are in <br />compliance with the above statute.
