RESOLUTION NO. 5306 <br />A RESOLUTION ADOPTING AMENDMENTS TO THE SYSTEM <br />DEVELOPMENT CHARGE METHODOLOGIES (GENERAL <br />METHODOLOGY AND APPENDICES A, E AND F) ORIGINALLY <br />ADOPTED BY RESOLUTION NO. 4900; REPEALING RESOLUTION NO. <br />4929; REPEALING RESOLUTION NO. 4977; DECREASING SDC <br />ADMINISTRATIVE FEES; PROVIDING A PHASED SDC INCREASE; <br />AND PROVIDING AN EFFECTIVE DATE. <br />The City Council of the City of Eugene Finds as follows: <br />A. The City of Eugene System Development Charge Methodologies document was <br />adopted by Resolution No. 4900, effective on May 7, 2007 and has subsequently been amended, <br />most recently by Resolution No. 5254 on November 26, 2018. The most recent change to the SDC <br />administrative fee was made by Resolution No. 4977 on May 26, 2009. <br />B. The Eugene City Council held apublic hearing on January 21, 2020 to accept public <br />testimony on amendments to the System Development Charge Methodologies; testimony <br />suggested a phased increase in parks and recreation system development charges ("SDCs") and an <br />immediate decrease in the administrative charge imposed when any system development charge is <br />collected. <br />C. Based on estimates of the periodic and on -going direct and indirect costs associated <br />with complying with the requirements of state law and the cost of administering the SDCs, it is <br />feasible to immediately decrease the Administrative Fee percentage rate from 9% to 5%. The flat <br />rate will remain unchanged at $80.00. <br />D. While an increase in SDCs is necessary to keep up with the park and recreation <br />needs of the community, the economic difficulties faced by the community warrant an immediate <br />implementation of the SDC decreases approved by this ordinance and a phased implementation of <br />the SDC increases approved by this ordinance. <br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br />Section 1. The City of Eugene System Development Charge Methodologies are amended <br />as shown in Exhibits A, B and C to this Resolution more specifically described as follows: <br />A.
