The Eugene Bikeways Master Plan, which was previously adopted, and subsequently amended, by City Council motions and Resolutions, is now included as part of the recormnended TransPlan, and those Resolutions should be repealed. NOW, THEREFORE, THE CITY OF E[JGENE DOES ORDAIN AS FOLLOWS: Section 1. The "Transportation Element" (Section III.F.) of the Metro Plan is revised as set forth in Part I of Exhibit A attached and incorporated herein by this reference. Section 2~ Other axnendments to the provisions of the Metro Plan text necessary for consistency with adoption of a revised "Transportation Element" are adopted as set forth in Part of Exhibit A attached and incorporated herein by this reference. Section 3. The TransPlan, included in the Metro Plan by Ordinance No. 19385, enacted on April 28, 1986, and amended by Ordinance No. 19584, enacted on November 28, 1988, Ordinance No. 19857, enacted on June 8, 1992, Ordinance No. 19872, enacted on September 9, 1992, and Ordinance No. 19887 enacted on November 9, 1992, is hereby further revised as described in TransPlan (September 2001) set forth in Exhibit B attached and incorporated herein by this reference. Section 4. In addition to the Goals and Policies adopted in Section 1 above, the project lists included in the 1986 TransPlan as amended, with revisions resulting in the 20-year fiscally constrained Capital havestment Actions project lists (programmed and unprogranmaed projects) contained in Tables 1 a~ 2 and 3a of Chapter 3 of TransPlan (September 2001) are adopted by this reference and made a part of the Metro Plan. Project timing and estimated costs are not adopted as policy. Section 5. Resolution No. 2375, adopting the Eugene Bikeways Master Plan (February 24, 1975); and Resolution No. 2650 (April 11, 1997), Resolution No. 3103 (March 26, 1979), Resolution No. 4171 (March 12, 1990), Resolution No. 4318 (May 11, 1992) and Resolution No. 4410 (May 9, 1994) amending the Eugene Bikeways Master Plan, and any other amendments to the Eugene Bikeways Master Plan are hereby repealed, as of the effective date of this Ordinance. Sectioa6~ Although not part of this Ordinance, the City Council adopts the Legislative Findings set forth in the attached Exhibit C in support of this action. Section 7. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is ~br any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
