ORDINANCE NO. 28235 <br /> <br />AN ORDINANCE CONCERNING LAND USE <br />REGULATIONS; AMENDING CHAPTER 9 OF THE EUGENE <br />CODE, 1971; ADOPTING A SEVEP, ABILITY CLAUSE; AND <br />PROVIDING AN IMMEDIATE EFFECTIVE DATE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br /> A. On February 26, 2001, Ordinance No. 20224 was adopted by the Eugene City Council <br />and approved by the Mayor adopting a new Land Use Code by repealing various sections of the <br />Eugene Code, 1971 and adding Sections 9.0010 through 9.9710 to constitute a new Chapter 9 of the <br />Eugene Code, 1971. <br /> <br /> On May, 29, 2001, Ordinance No. 20229 was adopted by the Eugene City Council <br />aa~d approved by the Mayor amending Section 7 of Ordinance No. 20224 to provide an effective date <br />of August 1,2001. <br /> <br /> C. Following adoption of the Land Use Code, staff identified errors, omissions and <br />clarifications that can only be corrected through amendments to the code. These arnendments ha-ye <br />been compiled as a package of minor Land Use Code amendments, file number CA 01 ~2. <br /> <br /> D. Following notice to the Department of Land Conservation and Development, written <br />notice to interested parties and published notice in the Register-Guard, the Eugene and Lane County <br />Planning Commissions held a joint public hearing on the minor Land Use Code amendments on <br />September 11, 2001. On September 24, 2001, the Eugene Planning Commission recommended <br />Eugene City Council adoption of the minor Land Use Code amendments. <br /> <br /> E. The City Council has conducted a public hearing on adoption of the minor Land Use <br />Code amendments, and is now ready to take action based upon the above recorrnmendation and the <br />evidence and testimony already in the record as well as the evidence and testimony presented at the <br />Eugene City Council public hearing. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Section 9.0500 of the Eugene Code, 1971 is amended by adding a new definition <br /> <br />of"Equipment, Light" in alphabetical order therein, and amending the definition of~'Lot Coverage," <br /> <br />to provide: <br /> <br />Ordinance- 1 <br /> <br /> <br />
