Section 43~ Subsection (1) of Section 9.8405 of the Eugene Code, 1971, are amended to <br /> <br />provide: <br /> <br />9~8405 <br /> <br />&pplicabititw_9~f ProperBL Line Adjustment A_AEplications. <br />(1) A property line adjustrnent application is applicable to changes to the property <br /> lines of adjoining properties when all of the following exist: <br /> (a) A property line proposed for removal is not platted in a partition or <br /> subdivision plat. <br /> (b) A property line proposed for adjustment will not result in an increase in <br /> the number of parcels or lots. <br /> (c) A property line proposed for adjustment will not create more than 2 <br /> property line adjustments to any of the boundaries of an individual lot or <br /> parcel within a calendar year. This subsection does not apply to proposed <br /> property line adjustments undertaken by or on behalf of a governmental <br /> entity that affect the ability to preserve, manage, or expand park, open <br /> space, or natural resource areas. <br /> (d) The adjustment will result in less than a 200% change in the size of the lot <br /> or parcel. This subsection does not apply to proposed property tine <br /> adjustments undertaken by or on behalf of a govermnental entity that <br /> a~bct the ability to preserve, manage, or expand park, open space, or <br /> natural resource areas. <br /> <br />Section 44. Section 9.8415 of the Eugene Code, 1971, is amended by adding a new <br /> <br />Subsection (4) thereto, to provide: <br /> <br />9.8415 <br /> <br />Proper~ty Line Adj. gstment Approval Criteria. The planning director shall <br />approve, approve with conditions, or deny the property line adjustment application. <br />Approval or approval with conditions shall be based on compliance with the <br />following criteria: <br /> <br />(4) <br /> <br />Public assessments, liens, and fees with respect to the partition have been paid, <br />or: <br />(a) A segregation of assessments and liens has been applied for and granted by <br /> the city; or <br />(b) An adequate guarantee in a form acceptable to the city manager has been <br /> provided assuring the liens, assessments and fees will be paid prior to <br /> recording the property line adjustment. <br /> <br />Section 45.
