CONDEMNATION OF PROPERTY INTERESTS FOR THE LOWER AMAZON <br /> ENVIRONMENTAL RESTORATION PROJECT (JOB #3531) <br /> <br />Mayor Torrey opened the public hearing on a proposed ordinance authorizing the institution of <br />proceedings in eminent domain for the acquisition by condemnation of property interests for the <br />lower Amazon Creek Environmental Restoration Project. <br /> <br />Mayor Torrey determined there was no one present wishing to testify and closed the public <br />hearing. <br /> <br />In response to a question from Mr. Johnson, Mayor Torrey stated that the council did not wish to <br />have a staff presentation on the matter. <br /> <br /> 8. PUBLIC HEARING: AMENDMENT TO SECTION 2.016 OF THE EUGENE CODE <br /> RELATING TO INTERESTS IN CONTRACTS <br /> <br />Mr. Klein stated that the proposed Section 2.016 of the Eugene Code relating to councilor's <br />interests in City contracts had been changed since the City Council Work Session had raised <br />concerns about it. He referred to Section 2.016(4) of the proposed ordinance amending the code <br />distributed with the agenda of the meeting and pointed out (1) that application of the ordinance <br />was limited to contracts made or amended during a councilor's term of office, and (2) that <br />amendments to existing contracts were allowed during a councilor's term of office if they did not <br />involve any increase in price. <br /> <br />Mayor Torrey opened the public hearing. <br /> <br />Gary Rayor, 2373 Washington Street, stated that he had not realized his potential conflict of <br />interest when he decided to run for election as a City Councilor. He said that he planned to sell <br />his stock in OBEC Consulting Engineers before assuming office, but that he would remain as an <br />employee of the company and would not be affected by the code amendment. He recommended <br />approval of the proposed ordinance. He noted that the amendment did not appear to cover <br />issues related to indirect benefits related to partial ownership of a business holding a City <br />contract. <br /> <br />Mayor Torrey determined there were no other persons present wishing to testify and closed the <br />public hearing. He announced that the council would act on the proposed ordinance on <br />December 9, 1998. <br /> <br /> 9.
