~ not prohibited by a judgement, that a portion of the ordinance <br /> has been declared invalid... <br /> <br />Mr. Lidz stated that he did not believe the requested changes were substantial or substantive. <br /> <br />Mayor Torrey determined that the requested changes were an acceptable amendment to the <br />maker of the motion, Mr. Farr, and that there was no councilor had an objection to changing the <br />motion, and declared that the resolution proposed for adoption was amended. <br /> <br />Mayor Torrey asked Mr. Lidz if he believed sufficient due diligence had taken place for the <br />council to act on the motion. Mr. Lidz replied that he believed it had. <br /> <br /> The motion to adopt Resolution 4580 was approved, 7:1, with Mr. Lee voting <br /> opposed. <br /> <br /> 3. ALLEY AND STREET VACATION REQUESTS FOR A & K DEVELOPMENT (SV98-3 <br /> AND SV98-4) <br /> <br />Mr. Johnson announced that the council would consider Council Bill 4663, an ordinance vacating <br />the east-west alley located west of Almaden Street. <br /> <br /> Mr. Farr moved, seconded by Mr. Tollenaar, that Council Bill 4663, with <br /> unanimous consent of the council, be read the second time by council bill <br /> number only, and that enactment be considered at this time. The motion <br /> was adopted unanimously, 8:0. <br /> <br />Mr. Johnson announced that the council would consider Council Bill 4663 by number only. <br /> <br /> Mr. Farr moved, seconded by Mr. Tollenaar, that Council Bill 4663 be <br /> approved and given final passage. <br /> <br />Ms. Taylor said that she was concerned that the council was proceeding without giving ample <br />time for those who had said they were not consulted or did not understand what was happening. <br /> Ms. Taylor moved to lay the motion on the table. <br /> <br />Mayor Torrey determined that there was no councilor willing to second the motion of Ms. Taylor <br />and declared that it was not under consideration. <br /> <br /> The motion to approve Council Bill 4663 was approved, 7:1, with Ms. Taylor <br /> voting opposed. <br /> <br />Mr. Johnson announced that the council would consider Council Bill 4664, an ordinance vacating <br />the portion of West Fourth Avenue located west of Filmore Street. <br /> <br /> Mr. Farr moved, seconded by Mr. Tollenaar, that Council Bill 4664, with <br /> unanimous consent of the council, be read the second time by council bill <br /> number only, and that enactment be considered at this time.
