Mr. Johnson announced that the council would consider Council Bill 4664 by number only. <br /> <br /> Mr. Fart moved, seconded by Mr. Tollenaar, that Council Bill 4664 be <br /> approved and given final passage. <br /> <br />Mr. Tollenaar commented that though he felt it was important to separate the vacation under <br />consideration from traffic issues, it was setting an inappropriate precedent to imply that money <br />being paid by the applicant was to be used for traffic improvements in the area. <br /> <br />Ms. Taylor said she was concerned that citizens had stated that they had been promised a <br />different result from the project and were not being given a chance to express their views. <br /> <br /> The motion to approve Council Bill 4664 was adopted, 7:1, with Ms. Taylor <br /> voting opposed. <br /> <br />Ms. Nathanson asked for the privilege of changing her vote from "yes" to "no" on Resolution 4580 <br />regarding the AT&T and TCl merger out of concern that there was not adequate discussion to <br />determine if the resolution and agreement provided all of the protections to achieve the desired <br />results. <br /> <br />Mayor Torrey asked if the request of Ms. Nathanson was in order. Mr. Klein replied that it was in <br />order, if there was no objection from the council. <br /> <br /> Mayor Torrey determined there was no objection to having Ms. Nathanson <br /> change her vote and announced that the motion to adopt Resolution 4580 <br /> was approved, 6:2, with Mr. Lee and Ms. Nathanson voting opposed. <br /> <br /> 4. ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS IN EMINENT <br /> DOMAIN FOR THE ACQUISITION BY CONDEMNATION OF PROPERTY <br /> INTERESTS FOR THE LOWER AMAZON ENVIRONMENTAL RESTORATION <br /> PROJECT (JOB #3531) <br /> <br />Mr. Johnson announced that the council would consider Council Bill 4672, an ordinance <br />authorizing the institution of proceedings in eminent domain for the acquisition of property <br />interests for the Lower Amazon Environmental Restoration Project (Job #3531). <br /> <br /> Mr. Fart moved, seconded by Mr. Tollenaar, that Council Bill 4672, with <br /> unanimous consent of the council, be read the second time by council bill <br /> number only, and that enactment be considered at this time. <br /> <br />Mr. Fart asked how property owners were compensated for property which was acquired by the <br />City through eminent domain proceedings. City Engineer Les Lyle replied that appraisals done <br />by registered appraisers are used to set compensations. He said the appraisals would be <br />reviewed by a second appraiser, the Army Corps of Engineers, and the Bureau of Land <br />Management to ensure that fair compensation was provided. Mr. Johnson added that property <br />owners had recourse to a court proceeding, if they were not satisfied that the compensation set <br />was adequate. <br /> <br />Mr. Lyle stated that appraisers normally considered what was the highest and best use of a <br />property in combination with constraints on the use of the property in determining its value. <br /> <br />MINUTES--Eugene City Council December 9, 1998 Page 7 <br /> 11:30 a.m. Lunch Work Session <br /> <br /> <br />
