He said the City Charter <br />described specific causes for a councilor to forfeit office and that violation of interest in contract <br />ordinances was not one of the causes. <br /> <br />Mr. Tollenaar said he believed Section 14 of the City Charter was broad, clear, and <br />comprehensive and that the proposed ordinance was a "noble effort" to qualify the scope of the <br />prohibitions of the charter, but that he did not believe it would create immunity from the risk of <br />future litigation regarding the issues involved. Mr. Klein replied that the proposed ordinance did <br />not remove any possible argument that a contract violated the City Charter, but that it violated <br />the City Code. <br /> <br /> The motion to adopt Council Bill 4673 was approved unanimously, 8:0. <br /> <br />Mr. Johnson announced that the council would consider Council bill 4673 by number only. <br /> <br /> Mr. Fart moved, seconded by Mr. Tollenaar, that Council Bill 4673 be <br /> approved and given final passage. <br /> <br />Mr. Laue asked how the public was served by the change to the ordinance. Mr. Klein replied that <br />the ordinance would ensure that no litigation was possible regarding existing Ferry Street Bridge <br />construction and garbage service contracts. <br /> <br />Mr. Lee said he believed it was unfortunate that City Councilors-elect had to suffer scrutiny as <br />non-paid public officials. He said he was willing to consider changing the City Charter to avoid <br />such experiences in the future. <br /> <br />Mr. Fart stated that he was interested in having the council consider issues related to creating a <br />way to pay City Councilors. <br /> <br />Ms. Taylor said that she continued to be disturbed by the proposed changes and that she did not <br />see a good reason for them. She said she did not believe undue hardship would be created by <br />elimination of a City contract for garbage service. <br /> <br /> The motion was adopted, 7:1, with Ms. Taylor voting negatively. <br /> <br /> 6. CITY OF EUGENE SUPPLEMENTAL BUDGET <br /> <br /> Mr. Fart moved, seconded by Mr. Tollenaar, to adopt Resolution No. 4581, a <br /> resolution adopting a supplemental budget; making appropriations for the <br /> City of Eugene for the Fiscal Year beginning July 1, 1998, and ending June <br /> 30, 1999. <br /> <br /> Ms. Taylor moved to table the motion. <br /> <br />Mayor Torrey determined there was no other councilor wishing to second the motion of Ms. <br />Taylor and declared that it was not under consideration. <br /> <br />Ms. Taylor said that she believed there had been insufficient discussion regarding the <br />supplemental budget proposal by the Budget Committee. <br /> <br />MINUTES-Eugene City Council December 9, 1998 Page 9 <br /> 11:30 a.m. Lunch Work Session <br /> <br /> <br />
