AMENDMENT TO SECTION 2.013 OF THE EUGENE CITY CODE RELATED TO <br /> INTERESTS IN CONTRACTS <br /> <br />Mr. Johnson announced that the council would consider Council Bill 4673, an ordinance <br />concerning interests in contracts, and amending Section 2.016 of the Eugene Code, 1971. <br /> <br /> Mr. Fart moved, seconded by Mr. Tollenaar, that Council Bill 4673, with <br /> unanimous consent of the council, be read the second time by council bill <br /> number only, and that enactment be considered at this time. <br /> <br />Ms. Taylor stated that she was not ready to "abolish the whole thing," but that she believed <br />contracts established before a councilor took office should be allowed to continue. Mr. Johnson <br />pointed out that the proposed ordinance amendment currently being considered allowed <br />amendments to contracts covered by its provisions only if the amendment did not involve an <br />increase in its price and that new contracts were not allowed. Mr. Klein added that provisions for <br />permitting new contracts in which a councilor had an interest had been removed from the <br />proposed ordinance. <br /> <br />Mr. Farr observed that most councilors suffered financial losses because of their public service <br />and that it was not desirable for councilors to benefit from it. He said he believed the proposed <br />ordinance adequately dealt with the problems associated with the issue. <br /> <br />Mr. Nathanson stated that she had been uncomfortable with previous suggestions regarding new <br />contracts and was satisfied with the currently proposed ordinance. She asked if non-monetary <br />considerations were covered in the ordinance. Mr. Johnson said that it was his experience that <br />contract amendments only dealt with monetary or timing issues. Mr. Klein added that the term <br />"value" could include anything of value. <br /> <br />In response to a question from Ms. Taylor, Mr. Johnson explained that contract amendments <br />dealt only with a pre-determined scope of work. Mr. Klein said that he was uncertain whether an <br />existing City contract for sanitation services contained an expiration clause, but that the proposed <br />ordinance prevented the City from increasing the price of a contract, even though it allowed the <br />extension of its term. <br /> <br />Mayor Torrey asked if adoption of the ordinance would permit all City Councilors-elect to serve <br />their terms.
