ADMINISTRATIVE ORDER NO.56-22-02 <br />of the <br />City Manager <br />CORRECTING AND REPLACING ADMINISTRATIVE ORDER NO.56 <br />22-01,REPEALING ADMINISTRATIVE ORDER NO.56-21-08, <br />EMERGENCY ADOPTION OF RULES FOR MAP AND TAX LOT <br />17-04-36-42/10400,AND REESTABLISHING THE SITE AS CLOSED TO <br />THE PUBLIC ON JANUARY 18,2022. <br />The City Manager of the City of Eugene finds that: <br />The real property located at Assessor's Map and Tax Lot 17-04-36-42 /10400 on13thAvenue(and currently fenced)is owned by the City of Eugene,it was not open to the public, <br />and was posted with "No Trespassing"signs (hereinafter referred to as "the Property"). <br />A. <br />Over the last several months,a number of individuals have trespassed on thePropertybyerectingtentsandusingthePropertyasatemporarycampsite.Because of the COVID- <br />19 pandemic,the City exercised its discretionary enforcement authority and did not cite thoseindividualsfortrespass.On March 1 9,202 1 ,1 issued Administrative Order No.56-2 1-01 adoptingemergencyrulesfortheProperty.I subsequently extended those emergency rules twice,once byAdministrativeOrderNo.56-21-01 and again by Administrative Order No.56-21-08. <br />B. <br />C The amount of garbage and human waste has been accumulating at the Propertyandthereisasteadyincreaseinneighborsreportingunlawfulactivityoccurringbothatthe <br />Property and nearby.Since the onset of winter weather,the conditions of the Property havesignificantlydegraded.The City has regularly brought in deliveries of bark and other material formoisturecontrol,and site staff have worked with occupants to relocate tents to drier areas,and toreplacetentsthathavebecomeunusablebecauseofweatherandsiteconditions.However,recent <br />severe weather underscores that there is no reasonable solution to keep the site habitable. <br />St.Vincent de Paul Society of Lane County,service provider for a Safe Sleep siteandoperatorofseveralotherprogramsfundedinpartbytheCityforunhousedresidents,hasofferedtheuseofanindoorstructureattheDawntoDawnsiteat717Highway99North,as a waytoshelteroccupantsofthe13thAvenuetemporarycamp.The facility will be heated and occupantswillhaveaccesstofood,showers and laundry,and each occupant will be provided with a newsleepingbagandtent,and storage for personal belongings.The structure at Dawn to Dawn will be <br />offered first to occupants of the 13th Avenue temporary camp.Also,St.Vincent de Paul will hold <br />beds in its Dawn to Dawn program for occupants of the 13th Avenue temporary camp.Together, <br />these spaces will provide a healthier,safer shelter option for the people at 13th Avenue. <br />D. <br />City staff and St.Vincent de Paul will assist occupants with packing campsites andmoving,as desired and requested.Vehicles and staff are available to help with moving starting <br />January 10.To ensure that current occupants of the Property are timely relocated to safer living <br />conditions,the Property will be vacant no later than January 18,2022. <br />E. <br />Administrative Order -Page 1 of 2
