The draft Downtown Plan incorporates policies and policy direction from these <br />documents, in addition to numerous other studies and planning documents. Therefore, <br />the proposed refinement plan adoption is consistent with this criterion. <br /> <br />(d) New or amended provisions in a federal law or regulation, state statute, state <br />regulations, statewide planning goal, or state agency land use plan. <br /> <br />A number of new or amended provisions in relevant state and federal laws, regulations <br />and policies affect downtown, including Transportation Planning Rule (TPR, OAR 660- <br />12), which includes new provisions for Central Business Districts. The draft Downtown <br />Plan incorporates policies and policy direction in response to these regulations. <br />Therefore, the proposed refinement plan update is consistent with this criterion. <br /> <br />(e) A change of circumstances in a substantial manner that was not anticipated at <br />the time the Refinement Plan was adopted. <br /> <br />Significant changes have occurred in the regional economy and population growth of the <br />city which have substantially impacted downtown Eugene. Physical changes and <br />development, such as the removal of the former pedestrian mall and the construction of <br />the new Federal Courthouse have also significantly affected downtown. The purpose of <br />the updated Downtown Plan is to respond to these changes and provide a policy <br />framework for the desired character of downtown, as a vital, economically healthy, <br />pedestrian friendly city center. Therefore, the proposed refinement plan update is <br />consistent with this criterion. <br /> <br />Staff Conclusion for Proposed Refinement Plan Adoption (RA 03-3) <br />Based on the preliminary findings contained herein, staff concludes that the proposed <br />refinement plan adoption is consistent with the relevant criteria in EC 9.8424. <br /> <br />CRITERIA FOR EVALUATING PROPOSED LAND USE CODE AMENDMENT <br />CA 03-3 <br />9.8065 Code Amendment Approval Criteria. If the city council elects to act, it may, by <br />ordinance, adopt an amendment to this land use code that: <br /> (1) Is consistent with applicable statewide planning goals as adopted by the <br /> Land Conservation and Development Commission. <br /> (2) Is consistent with applicable provisions of the Metro Plan and applicable <br /> adopted refinement plans. <br /> (3) In the case of establishment of a special area zone, is consistent with EC <br /> 9. 3020 Criteria_for Establishment o_fan S Special Area Zone. <br /> <br />EC 9.8065(1) Is consistent with applicable statewide planning goals as adopted by <br />the Land Conservation and Development Commission. <br /> <br />Exhibit A - Ordinance 2 - 9 <br />C:XDocuments and Settings\ceplnxl\Local Settings\Temporary Internet Files\OLK238~Findings - Exhibit A <br />- Ordinance 2 (00069924)3.DOC (02/02/04) <br /> <br /> <br />
