ORDINANCE NO. 20149 <br />AN ORDINANCE CONCERNING THE DOWNTOWN MALL; <br />AMENDING SECTION 4.680 OF THE EUGENE CODE, 1971; <br />AMENDING THE SUNSET PROVISION OF SECTION 3 OF <br />ORDINANCE NO. 20122; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that <br />A. On June 8, 1998 Ordinance No. 20122 was passed by the Council and approved by <br />the Mayor adding a new Subsection (3) to Section 4.680 of the Eugene Code, 1971 (and renumbering <br />the current Subsection (3) to (4)). The new Subsection (3) prohibits persons from being within the <br />Broadway portion of the downtown mall between the hours of 1:00 a.m. of one day and 6:00 a.m., <br />except as provided in that subsection. Section 3 of the Ordinance, which was not included in the <br />Code, provided an automatic repeal of Ordinance No. 20122 and the new Subsection (3) of Section <br />4.680 of the Eugene Code, 1971 effective midnight, March 31, 1999. <br />B. It would be in the public interest to amend Subsection (3) of Section 4.680 of the <br />Eugene Code, 1971 to revise the geographic boundary, and to continue the Ordinance in effect until <br />Apri130, 2001 by amending Section (3) of Ordinance No. 20122. <br />NOW, THEREFORE, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection (3) of Section 4.680 of the Eugene Code, 1971, is amended to <br />provide: <br />4.680 Acts Prohibited at Night. <br />(3) Between the hours of 1:00 a.m. of one day and 6:00 a.m., no person shall be in <br />Ordinance - 1 <br />
