ORDINANCE NO. l ~'1 ~j ~'Z-- <br />A SPECIAL ORDINANCE G G A LIMITED <br />EXEMPTION TO '1`HE APPLICATIgN OF EUGENE CODE, <br />1971, SECTIONS 4,G84 AND 4.815; PRgvIDING FOR AN <br />AUTOMATIC REPEAL AS qF JUNE 1, 1994; AND <br />DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds as follows: <br />A. The City Council has publicly acknowledged its awareness of the severity of <br />problems facing homeless persons within the City and has initiated and supported measures <br />directed towards the alleviation of those conditions, <br />B. A proposal has been made that homeless persons be permitted to camp on <br />a temporary basis and for a limited period of time in a designated portion of Alton Baker <br />Park. Such camping is presently prohibited by Sections 4.6$02} and 4.$15 of the Eugene <br />Cade, 1971 SEC}. <br />C. It would be in the public interest and further City Council policies to grant a <br />limited and unique exception to the enforcement of EC Sections 4.6$02} and 4.$15 for a <br />designated portion of Alton Baker Park. This limited exception is granted on a trial basis <br />only and should not serve as a precedent far future exceptions, nor interfere with the <br />continued enforcement of EC Section 4.$15 in other portions of the City. <br />NOW; THEREFgRE, <br />THE CITY qF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The findings set forth above are adopted. <br />Section Z, Notwithstanding Sections 4.6$02} and 4,$15 of the Eugene Code, 1971, <br />the City Manager shall designate an area within the three western-most parking bays of the <br />WISTICIAIton Baker parking area to be used by homeless persons for car or tent cam in . <br />Pg <br />The Manager shall designate not more than fifty sites for camping. The Manager shall <br />designate such sites as soon after the effective date of this ordinance as is practicable. The <br />Manager may adapt administrative rules to govern use of the campground, including <br />provisions related to allocation of the sites, and payment of a fee for use of the campground. <br />The Manager also may contract with anon-profit provider to manage the day-to-day <br />operations of the campground. <br />Section 3.
