1.fiO0 Vacation of Im roved Ri hts-of-Wa and Unim roved Streets or Alle s <br />- Grant ar Denial of Petition <br />~ 1 } The cvunci l may, upon heari ng a peti ti on for a vacat i on of an <br />improved or unimproved right-of -way, grant the same i n what a or i n part, or may <br />deny the same i n whole or i n part, or may grant the same with reservations <br />pertaining to the maintenance and use of all public utilities and f aci 1 i t i es i n <br />the portion vacated. When unimproved rights-af-way and streets and alleys are <br />vacated, pedestrian and bicycle easements are to be retained i f the caunci 1 <br />determines it will serve a public need. The council may make an assessment and <br />provide for the payment to the city of a sum of money as the council may find to <br />be just and equitable as an assessment of special benefit of the real property <br />abutting on the vacated area ar a benef i t to the property which, by reason of the <br />vacate on abuts on a vacated area, and the cost of curbs, drainage, paving, sewer <br />or other 1 ocal improvements already completed or to be constructed upon the area <br />vacated. The assessments, together with all costs shall not exceed the amount <br />of special benefit resulting or inuring to the abutting property by reason of the <br />vacation. <br />~ 2 } I n the event a pet i t i on i s who11 y denied, the deposit shall be <br />retained. Any money retained, and any sum assessed and collected as benefits, <br />shall be paid into the finance office. <br />Section l . The def i n i t i ans of "Bi cyci a storage" and "Vision clearance <br />area" set forth in Section 9.015 of the Eugene Code, 1911, are hereby amended, <br />and the following definitions added i n a1 phabeti cal order therein, to provide: <br />9.015 Definitions. As used in this chapter, unless the context requires <br />otherwise, the following words and phrases mean <br />Accesswa . An interconnecting paved walkway that provides <br />pedestrian and or bicycle passage. <br />Bic cle facilities. Improvements which provide for the needs <br />of cyclists, including bicycle paths, bicycle routes, and bi cycl e <br />parking fac~1 ~t~es. <br />Bic cl a arki n s ace. A space far one standard bicycle, <br />adequately lighted, i n a secure bicycle rack, placed i n a paved <br />area. <br />Bike_ path. A bike path is a bikeway that is physically <br />separated from motor vehicle traffic by an open space or barrier, <br />and may be within the public right-of -way, easement or other publ i G- <br />owned land. <br />Car ool . A group of two or more commuters, including the <br />driver, who share the ride to and from work and other destination. <br />Commercial develo ment. A building ar buildings for office or <br />retail use. <br />Direct connection. The shortest reasonabl a connection between <br />two points .
