P. Based on the recommendation of the Planning Commission, the public <br />testimony before the Commission and this Council, and staff notes and back round <br />. g <br />materials, the City Counc~I has determined that the May 1994 Draft Whiteaker Plan is <br />consistent with the Eugene-Springfield Metropolitan Area General Plan, as acknowled ed <br />g <br />by the Land Conservation and Development Commission, and consequently, the Whiteaker <br />Plan conforms to applicable statewide planning goals. <br />NGV~', THEREFORE, <br />THE CITY GF EUGENE DOES gRDAIN AS FGLLaWS: <br />Section 1. Based an the above findings, and the findings set forth in Exhibit C <br />attached hereto and incorporated herein by reference, which are hereby adopted, and <br />subject to the limitations set forth in Sections 4 and 5, the 'L~hiteaker Plan attached as <br />Exhibit A hereto and incorporated herein by reference, including the policies set forth <br />therein, is hereby adopted as a refinement of the Eugene-Springfield Metro olitan Area <br />p <br />General Plan. <br />Section 2. The supporting text, maps, graphs, and tables contained in the Whiteaker <br />Plan and the Whiteaker Plan Appendix are also adopted as additional findings. <br />Section 3. The Plan Diagram included in the Whiteaker Plan, as revised in Exhibit <br />A hereto, is hereby adopted as a refinement of the Eugene-Springfield Metro olitan Area <br />p <br />General Plan. The explanatory text discussing the Plan Diagram des~gnatlons and subareas <br />is intended to clarify and provide further explanation of the intent of the Metro Plan <br />iagram. <br />Section 4. The implementation strategies set forth in the Whiteaker Plan are <br />recognized as potential ideas on how to address the policies, but are not adopted as Ci <br />tY <br />pahcy. <br />Section 5. The list of Planning Commission Short-Term Implementation Priorities <br />attached as Exhibit B hereto and incorporated herein by reference is recognized as providing <br />direction for the timing of implementation activities. It is recognized, however, that several <br />factors will impact implementation, including project complexity and bud et constraints . <br />g <br />Section 6, If any section, subsection, sentence, clause, phrase, or portion of this <br />Ordinance is for any reason held invalid or unconstitutional by a court of com etent <br />. P <br />jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and <br />such holding shall not affect the validity of the remaining portions hereof. <br />Section 7.
