Exceptions to minimum lot and parcel <br />platting standards will not be allowed on residentially <br />zoned remainder parcels. <br />d. On remainder parcels, exceptions to minimum <br />lot and parcel platting standards in agricultural, <br />commercial and i ndustri a1 zones wi 11 be no more than the <br />minimum needed to accomplish the purpose of the <br />conservation land division. <br />3. The c~ ty shall keep records of approved remainder <br />parcels to ensure that zoning reviews on future building <br />permit applications are consistent with that approval. <br />Section 3. Anew Section 9.262 is added to the Eugene Code, 1911, to <br />provide: <br />9.262 Waterside Protection Provisions. <br />~ 1 } Pur ose . The primary objective of the Waterside Protection <br />Sub-district i s to protect water quality i n desi gnated rivers, channels, streams, <br />riparian areas, wetlands, and upland headwater streams . This sub-district i s <br />also intended to protect wi 1 dl i f e habitat and prevent property damage from storms <br />and floods. <br />The provisions of this sub-district are intended to implement policies in <br />the Metropolitan Plan which call for protection of riparian vegetation, wetlands, <br />waterways, wi 1 dl i fe habitat, and surface and ground water quality. <br />The waterside protection sub district is also intended to maintain or <br />enhance open space areas adjacent to water features. These open space areas are <br />important because they contain native vegetation; convey, stare, or improve the <br />quality of urban starmwater runoff ; prov ~ de habitat for wi 1 dl i f e and, where <br />appropriate, can provide 1 egal ly obtained access for channel maintenance. Uses <br />and activities permitted i n these. areas are restricted i n most cases to those <br />that are consistent with the purpose of this sub-district. Where conflicting <br />uses or activities must occur, site plan approval based upon conformance with <br />specified natural resource special standards ~ from section 9.305} i s required to <br />minimize adverse impacts. <br />~2} A~,lp icabilit . The waterside protection sub-district applies <br />to streams, rivers, channels, panels and other water features and adjacent areas <br />specified for protection in an adapted plan. <br />~a} Specifically, this sub-district encompasses parcels any <br />part of which contain or are within waterside protecti an areas as <br />described in this section. <br />fib} The provisions of the waterside protection sub-district <br />do not exempt a person or property from state or federal 1 aws and <br />regulations that protect water quality, wetlands, yr other natural <br />areas. <br />~c} In some cases, the waterside protection sub-district may <br />overlap with the Natural Resources ~NR} district or the wetland <br />buffer sub-di stri ct. ~ In these cases, only one review process i s <br />required as follows: <br />Drdinance - 1 <br />
