Findvags and Recommendations <br />Final Assessment Costs for Job #31$7 <br />January 3,1995 <br />Page 2 of 2 <br />RECGMMENDATIQN <br />A public hearing regarding the proposed assessment was scheduled for b:00 p.m. on December 20 <br />1995. This hearing was canceled because no one wished to offer testimony. The Hearings Official <br />received a December 20,1995 memorandum from the City Engineer Exhibit A} outlining the <br />above information. Cost estimates were based on the low bid and the final improvement costs are <br />lower than those quoted at the local improvement hearing and are comparable to projects of similar <br />size. Staff recommends approval of the assessment as calculated and that the Council levy the final <br />assessment. <br />Based upon the available information, it is the finding of the Hearings Df~cial that this project has <br />been uutiated, bid and constructed in accordance with the provisions of the Eugene Code. It is the <br />further finding of the Hearings Dfficial that the final improvement costs are lower or equal to those <br />quoted at the local improvement hearing and are comparable to most projects of this type. <br />Finally, the Hearings Dff~cial finds that the proposed assessments are calculated in accordance with <br />the Eugene Code and that the project is one for which the assessments are far a local improvement <br />as set forth in SRS 310.140 because: <br />~ 1 } The assessments do not exceed actual costs; <br />~2} The assessments are imposed for a Capital Improvement Construction Project <br />which provides a specific benefit to a specific property or rectifies the problem <br />caused by a specific property; <br />~3} The assessments are imposed in a single assessment upon completion of the project; <br />and <br />(4} The assessments allow the property owners to elect to pay off with interest aver at <br />least ten ~ 10} years. <br />Therefore, the Hearings official recommends that the City Council adopt an ordinance for the <br />assessment as set forth by the City Engineer. <br />Respectfully submitted, <br />Gar .
