PUBLIC HEARING <br />Eugene Public Works staff provided the Hearings Official with a Memorandum which outlined <br />the information set forth above. A public hearing was held on Apri123,1996, at 6:00 p.m. in the <br />Conference Room of the Public ~V'orks Department 2Z5 E. Broadway. Hearings Official Milo <br />Mecham presided. A copy of the minutes of that public hearing are attached as Exhibit A, and a <br />copy of the Memorandum provided by staff is attached as Exhibit B. <br />As described in the minutes, one property owner attended and asked questions concerning the <br />project. The questions concerned the timing of the sewer connections, the rationale for Systems <br />Development Charges, and financing options, The questions were answered and the property <br />owner was given the addresses of the City officers where more information could be obtained. <br />FINDINGS AND RECGMMENDATIUN <br />The Hearings Official finds that notice of the public hearing was provided, all the property <br />owners .were given an opportunity to participate in the hearings, and that the public hearing was <br />conducted in accordance with the relevant provisions of the Eugene Code. <br />The Hearings Officer also finds that the project is one for which the assessments are for local <br />improvements as set forth in ORS 310.410 because <br />1. The assessments do not exceed actual costs; <br />2. The assessments are imposed for a capital construction project which provides a <br />specific benefit for a specific property or rectifies a problem caused by a specific <br />property <br />3. The assessments are imposed in a single assessment upon completion of the <br />project; and <br />4. The assessments allow the property owners to elect to pay the assessment with <br />interest over at least ten ~ 10} years. <br />The Hearings Official also finds that the final improvement costs are lower than quoted at the <br />local improvement hearing and are comparable to projects of similar size. <br />Recommendation <br />The Hearings official recommends approval of the assessment distribution.
