I interpret that term to mean <br />impacts of the nature of those specifically listed that relate to <br />features and operating characteristics of the use itself.. Here <br />part~.cularly, where a permitted use in the C--3 district could be <br />developed. that would not only eliminate, parking on the site but <br />would have arking needs ~ of its awn that would have to be fulfilled <br />p <br />by other parking facilities, the elimination of the surface parking <br />on the subject site is not a relevant impact. <br />The effect of construction activity has not previously been <br />identified as a "relevant impact" and I find that, while it is <br />desireable to mitigate its effects, it is not a characteristic of <br />the use itself, therefore, its impact is not required to be <br />addressed pursuant to EC 9.7 0 ~ ~ a } .. <br />Section 9.702 b The location, design, and related <br />features of the proposed development will provide a <br />convenient and functional living, working, shopping or <br />civic environment, and will be as attractive as the <br />nature of the use and its location and setting warrant. <br />This criterion is interpreted to address evaluation of the use <br />within the site , as opposed to off -~s~te impacts o f the use . The fact that the use has functioned in almost the <br />identical location for a period of nearly 20 years is a positive <br />indication of the site's functionality. <br />The articular location is convenient and functional in that it~is. <br />p <br />in~ close roximity to the downtown mall and city center commercial <br />p <br />district and the broad range of goads and services found there. <br />While close to the very center of the city, it has immediate access <br />to a surrounding system of arterial streets. This renders <br />immediate access to the transit systems's service area by means of <br />both east and west arterial streets, llth and 13th Avenues, and <br />north and south access by means of the oak and Pearl arterial <br />couplets. This is an important and functional aspect of the <br />transit districts radial bus service configuration.
