Exhibit A <br /> <br /> MINUTES <br /> Local Improvement District Formation <br /> Paving, Construction, Curbs, Gutters, Sidewalks, Median Street Lights, Traffic Signal, <br /> Street Trees, Wastewater and Stormwater Drainage on Garden Way from Sisters View <br /> Avenue to Martin Luther King Jr. Boulevard, and the north side of Martin Luther King, <br /> Jr. Boulevard from Marche Chase Drive to I-5. <br /> <br /> March 17, 2004 Public Heating <br /> <br /> Heatings Official Milo Mecham convened the hearing at 6:05 p.m. He described <br />the subject matter of the heating and procedures to be followed at the hearing. Present at <br />the hearing representing the City of Eugene was Principal Engineer Paul Klope and <br />Project Engineer Steve Gallop. <br /> <br /> Principal Engineer Paul Klope began the City's presentation by briefly describing <br />the project's history. Mr. Klope explained that the project was identified in the FY 98-03 <br />Capital Improvement Program, adopted by the Council in 1997, and the FY 98 Capital <br />Budget adopted in June, 1997. Following that initiation, there was a series of public <br />meetings, formal and informal, concerning the project. Mr. Klope described how this <br />project was one of several projects under way that led, in 2001, to revisions in the City's <br />public improvement assessment policies. The changes were briefly described and a <br />handout on the changes was distributed. <br /> <br /> Mr. Klope then described the changes in land use policy that also affected the <br />development of this project. The most significant change came in 2002, when the City <br />Council held hearings and adopted a Nodal Development Plan for the Garden Way area. <br />All of these developments culminated in the city council adopting a motion on November <br />12, 2002, to approve the proposed design of the improvements to Garden Way. In <br />December 2003 the Lane County Board of Commissioners authorized assessment of <br />properties outside the City of Eugene for the Garden Way improvement project. <br /> <br /> Mr. Klope described the nature of the project, including the street improvements <br />and the safety features. The project will have two traffic lanes, with a center turn lane, it <br />will have sidewalks, street trees and street lights, and the other amenities associated with <br />a collector street. <br /> <br /> Mr. Klope described the proposed assessments. After bids were received and <br />reviewed, Wildish Construction was determined to be the apparent low bidder. Mr. <br />Klope discusses each component of the estimated assessments. Property owners are <br />proposed to be assessed less than one third of the total project cost. The City will pay the <br />cost of the excess pavement width, the intersection costs, approximately three fourths of <br />the storm drainage costs, and other special costs that have been determined to not benefit <br />the property owners within the district. Mr. Klope explained the Council policies <br />concerning limiting total assessments, and deferring some assessments, based on the <br /> <br /> <br />
