Administrative Order - Page 1 of 2 <br />ADMINISTRATIVE ORDER NO. 58-22-24 <br />of the <br />City Manager of the City of Eugene <br /> <br />EMERGENCY AMENDMENT OF SHARED MICROMOBILITY <br />SERVICE LICENSE ADMINISTRATIVE RULE R-3.570 ADOPTED BY <br />ADMINISTRATIVE ORDER NO. 58-22-02-F. <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Section 2.019 of the Eugene Code, 1971 (EC), authorizes the City Manager or <br />designee to adopt rules for implementation of any provisions of that Code. EC 2.019(6) authorizes <br />the City Manager to adopt emergency rules without prior public notice or hearing. <br /> <br />B. On April 19, 2022, I issued Administrative Order No. 58-22-02-F adopting Shared <br />Micromobility Service License Administrative Rule R-3.570. <br /> <br />C. Since the adoption of Rule R-3.570, City staff have learned that the privacy policy <br />required of licensees by R-3.570-B(1)(h).1 would be prohibitively disruptive to a licensee’s <br />business, effectively rendering it too inefficient because it is substantially different from that of <br />the industry standard used in dozens or even hundreds of cities, and place an unreasonable burden <br />on City staff to review each case. <br /> <br />D. Establishment of an emergency rule to conform the City’s licensure program to <br />current industry standards without prior public notice pursuant to subsection (6) of Section 2.019 <br />of the Eugene Code, 1971, is necessary so that a shared micromobility services license can be <br />issued by the City in advance of the World Athletics Championships, when an anticipated 200,000 <br />visitors will need ways to travel to, from, and between hospitality and retail locations and Hayward <br />Field, to reduce reliance on car rentals and public passenger vehicles and, consequently, reduce <br />congestion on city roads and greenhouse gas emissions. <br /> <br />NOW, THEREFORE, based upon the above findings and pursuant to the authority in <br />subsection (6) of Section 2.019 of the Eugene Code, 1971, I order that the amendments to Shared <br />Micromobility Service Licenses Administrative Rule R-3.570 shown in legislative format below <br />are immediately effective, and remain in effect for 180 days unless replaced earlier by an <br />emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions of <br />EC 2.019 of the Eugene Code, 1971. <br /> <br /> <br />SHARED MICROMOBILITY SERVICE LICENSE <br />ADMINISTRATIVE RULE R-3.570 <br /> <br />1. Administrative Rule R-3.570, adopted by Administrative Order No. 58-22-02-F is <br />amended to incorporate the following revisions to Section R-3.570-B(1)h:
