From what I have been able to <br />glean from the available information, the end effect will be to turn residential properties <br />into "riparian habitats." Beyond questioning what appears to be a well-intentioned effort <br />to preserve our natural heritage which has apparently has "run amok," and proposes to <br />expropriate urban residential backyards without compensation, there are legal issues <br />which I wonder ifhave been considered by anyone among either elected or salaried city <br />officials. <br /> <br />Therefore I would like to pose the following questions which should have been answered, <br />but have apparently been ignored in not only this matter but in city planning in general. <br />Has the city of Eugene determined that active Federal Land Patents exist for most of the <br />private properties in the south hills? And that Federal Land Patents have been confirmed <br />in multiple court decisions to take precedence over any state or local rights of <br />expropriation? It appears that once again city employees have expended taxpayers time <br />and money without doing their homework. All Federal land patents are readily available <br />in the Federal Archives in Washington. Furthermore, has the city also taken the time and <br />effort to determine if certain street donations from Lane County were in fact legal? Has <br />the city also determined that there are no original, signed legal documents for some land <br />donations to Lane County which were later relinquished to the city? Can the county give <br />land to the city, particularly federally patented land, which it never legally owned?
