Curr$ntly we have built new homes on Lot's 1 thru 6 and 17,lS,and 18 and have <br />construction in progress On Lot'~ 6 and 14. Lot 8 is sold and ~ue to start Con$truction <br />in October. Lot 13 is sold but doe~n't plan to start construction til spring of 2006. <br /> <br />My concern is with the 20' setbacks required from the top Qf the bank especially as it <br />concerns Lot's 7 and 14_ A 20 ' setback would render these two lots unbuildable _ tnese <br />two lots are currently on the market for $125,900 and $139,950 respectivelely so you Can <br />readily see that <br />we would incur a substantial loss if the city and state were to impos~ the 20' ~etback <br />restrict~ons on these two lotRs. <br /> <br />Mallard Lake subdivision has been approved without the 20' set~ack restriction$ <br />that would be imposed if Go~l 5 were to be apprQved without any exceptions. In my mind <br />this <br />would not only be unethical and a breach of meaSUre 37 but stupid and costly tQ the city <br />and state as well. Even approving building On said lots with a variance would not be <br />acce~t~te because of extra costs and delays in construction that are not necessary_ <br /> <br />Please exclud~ any reference to Mallard Lake Estates aka Golden Gardens(Dssoto Lake)on <br />your <br />ESEE ~onclusion Summary Table. <br /> <br />L would appreCiate a timely response ,to this letter. <br /> <br />Sincerely, <br /> <br />Oaniel M.
