My wife and 3 children recently relocated to Eugene and we <br />are looking forward to growing with and making Eugene our home. When we purchased <br />our home and property at 4066 Spring Knoll Drive, we checked with the City and <br />repeatedly asked how our property was zoned and the response was always that is was <br />zoned R-1 prior to our home purchase. It wasn't until we attended a home owners' <br />meeting that we found out about pending Goal 5 overlay re-zoning. This came as a big <br />surprise due to the fact that we made every honest attempt to obtain any information <br />pertaining to this property in regards to zoning. <br /> <br />I am requesting that our property at 4066 Spring Knoll Drive be removed from the Goal- <br />5 program for the following reasons: <br /> <br />1. As it is currently shown in the aerial survey map provided by the Eugene <br />Planning commission the Goal 5 program re-zones approximately .4 acres of <br />our 1.26 acre lot. Over 30% of our property will have limited uses placed on <br />them. <br /> <br />2. From the Map; newly proposed setbacks encroach on previously built and <br />established out buildings and yard areas. <br /> <br />3. None of these Zoning plans were disclosed to us prior to purchasing this <br />property and the re-zoning severely impact our plans on property <br />improvements. <br /> <br />( <br /> <br />4. Currently 1 + acre lots in this area are selling for between $300,000- $400,000 <br />(please see attached real estate advertisement for neighboring lot). This would <br />make the Goal 5 area which is proposed worth approximately $100,000 to <br />$115,000. Although Public entities! Municipalities have the right to rezone <br />and annex property, the United States Supreme court (courts) have also ruled <br />
