Exhibit A to Administrative Order No. 44-23-01-F <br />City of Eugene Public Contracting Rules 2022 – Part 1 Page 10 <br /> <br />of the property over the period for which the property will be used by the Contracting Agency. A record <br />shall be made of the Findings that support any purchase over $10,000. <br />The provisions of this rule are further limited by ORS and/or federal regulations. <br /> <br /> <br />E16. Temporary Use of City-Owned Property <br />Contracting Agency may negotiate and enter into a license, permit, or other contract for the temporary <br />use of city-owned property without using a competitive selection process if: <br />1) The contract results from an unsolicited Proposal to the city based on the unique attributes of the <br />property or the unique needs of the proposer; <br />2) The proposed use of the property is consistent with the city’s use of the property and the public <br />interest; and <br />3) The city reserves the right to terminate the contract without penalty, in the event that the city <br />determines that the contract is no longer consistent with the city’s present or planned use of the <br />property or the public interest. <br /> <br /> <br />E17. Liability Insurance Contracts <br />Contracts for insurance where either the annual or aggregate premium exceeds $10,000 must be let <br />using one of the following procedures: <br />1) Agent of Record: Contracting Agency may contract with a licensed insurance agent (“agent of <br />record”) to perform insurance services in connection with more than one insurance contract. This <br />service is considered a Personal Service and will be awarded pursuant to rules governing Personal <br />Service contract awards. <br />a) Among the services to be provided is the securing of competitive proposals from insurance <br />carriers for all coverages for which the agent of record is given responsibility. <br />b) Any contractual period shall not exceed five years. Agents may serve more than one contractual <br />period. Agents must qualify for contract prior to each period as if each contractual period was the <br />first. <br />c) In selecting an agent of record, Contracting Agency shall select the agent(s) most likely to perform <br />the most cost-effective services. <br />2) Specific Proposals for Insurance Contracts: Contracting Agency may solicit proposals from licensed <br />insurance agents for the purpose of acquiring specific insurance contracts subject to the following <br />conditions: <br />a) Contracting Agency shall make reasonable efforts to inform known insurance agents in the <br />competitive market area of the subject matter of the contract, and to solicit proposals for providing <br />the services required in connection with the contract. Such efforts may include posting notice on <br />Contracting Agency’s website and an electronic procurement system. <br />b) Contracting Agency shall select an agent on the basis of the most competitive offer considering <br />coverage, premium cost, and services to be provided.
