The Solicitation Agent shall notify any applicant who fails to <br />qualify for participation in a pool that it may appeal the Solicitation Agent’s decision Purchasing <br />Agent in the manner described in Division 47. <br />H) Selection from a Qualified Pool. Contracts of not more than $100,000 in fiscal year may be <br />awarded from a Qualified Pool by any method deemed appropriate by the Solicitation Agent. <br />Personal Services not exceeding a total of $150,000 over the life of the contract may also be <br />awarded from a Qualified Pool under an Intermediate Procurement pursuant and subject to <br />Division 47 of these Rules. <br />3) The selection procedures described in this section may be waived by Contracting Agency, in its <br />discretion, where an emergency exists that could not have been reasonably foreseen which requires <br />such prompt execution of a contract to remedy the situation that there is not sufficient time to permit <br />utilization of these selection procedures. <br />4) Contracts for Continuation of Work. Contracts of not more than $150,000 may be awarded for the <br />continuation of work by a contractor who performed preliminary studies, analysis or planning for the <br />work under a prior contract, if the prior contract was awarded under a competitive process and the <br />Solicitation Agent determines that use of the original contractor will significantly reduce the costs of, <br />or risks associated with, the work. <br />5) Amendments. Personal services contracts may be amended, provided the amendment is within the <br />scope of the original contract and the cumulative amount of all amendments does not increase the <br />total contract price by more than 25% over the original contract price unless approved by the <br />Purchasing Agent. <br />6) Nothing contained in this section shall preclude Contracting Agency from complying with provisions <br />of Federal or State law that require Contracting Agency to utilize a different selection or contracting <br />procedure. <br />7) Per Rule 137-046-0130(4), Personal Service Contracts are exempt from the requirements of ORS <br />279.835 to 279.855. <br /> <br /> <br />E19. Concession Agreements. <br />1) Concession Agreement has the meaning set forth in Eugene Code 2.1420. <br />The Purchasing Agent has adopted the following classifications and rules for the award of Concession <br />Agreements. <br />2) Classes of Contracts Eligible for Award Without Competition. Concession contracts that meet the <br />following criteria may be awarded by any method deemed appropriate by the Solicitation Agent, including <br />without limitation, by direct appointment, private negotiation, or using a competitive process. <br />a) Contracts Under $10,000. Contracts under which the Solicitation Agent estimates that receipts by the <br />Contracting Agency will not exceed $10,000 in fiscal year. <br />b) Single-Event Concessions. Concessions to sell or promote food, beverages, merchandise, or <br />Services at a single public event shall be awarded based on any method determined by the <br />Solicitation Agent to provide a fair opportunity to all persons desiring to operate a concession, but in <br />which the promotion of the public interest and success of the event shall be of predominant <br />importance.
