Contracts in any amount that are determined in accordance with the regulations in <br />Division 47 of these Rules to be only available from a sole-source vendor. <br />3) Competitive Award. Concession Agreements solicited by the Contracting Agency for the use of <br />designated public premises for a term greater than a single event shall be awarded as follows: <br />a) Small Concessions. For Concession Agreements for which the concessionaire’s projected annual <br />gross revenues are estimated to be $500,000 or less, the Purchasing Agent has discretion to use <br />either an Informal Solicitation or a Request for Proposals process. If the Offers received indicate a <br />probability that the concessionaire’s annual gross revenues will exceed $500,000, the Solicitation <br />Agent may, but shall not be required to, reissue the Solicitation as a Request for Proposals. <br />b) Major Concessions. Concession Agreements for which the concessionaire’s projected annual gross <br />revenues under the contract are estimated to exceed $500,000 annually shall be awarded using a <br />Request for Proposals under Division 47 of these Rules. <br />4) General. No part of a Concession Agreement shall contain or constitute a waiver of any generally <br />applicable Rules, code provisions or requirements of the Contracting Agency concerning regulation, <br />registration, licensing, inspection, or permit requirements for any construction, rental, or business activity. <br /> <br /> <br />E20. Disposition of Surplus Personal Property <br />1) Surplus Property has the meaning set forth in Eugene Code 2.1420. <br />2) The Contracting Agency may dispose of surplus personal property, other than residential buildings or <br />structures being separated from real property in accordance with the policies and procedures approved <br />by the Purchasing Agent.
