Under ORS <br />279B.060(9)(b), the director or other head of a state Contracting Agency may waive the at <br />least thirty-percent-to-Contract-price final evaluation weighting requirement of ORS <br />279B.060(3)(e) and (9)(a) in the conduct of a multi-tiered or multistep selection process. In <br />making a determination that a waiver is in the best interest of the state Contracting Agency, <br />the director or agency head may consider the factors identified in OAR 137-047-0260(6). A <br />director or agency head that waives the thirty percent weighting requirement must comply <br />with the documentation and reporting requirements of OAR 137-047-0260(7). <br />13) Unless the Legislative Assembly extends the thirty-percent weighting requirement of ORS <br />279B.060(3)(e) and (9)(a) beyond the January 2, 2020 expiration date anticipated by 2018 <br />Oregon Laws, chapter 85, sections 4 and 8(2), OAR 137-047-0260(6) and (7) and section <br />(12) of this rule expire on January 2, 2020. <br /> <br />Related State Statutes: ORS 279A.065, ORS 279B.060 <br /> <br /> <br />137-047-0265. Small Procurements <br />1) Generally. For Procurements of Goods or Services less than or equal to the dollar amount <br />stated in ORS 279B.065 a Contracting Agency may Award a Contract as a small <br />Procurement pursuant to ORS 279B.065. <br />2) Amendments. A Contracting Agency may amend a Contract Awarded as a small <br />Procurement in accordance with Rule 137-047-0800, but the cumulative amendments shall <br />not increase the total Contract price to greater than one hundred twenty-five percent <br />(125%) of the dollar amount stated in ORS 279B.065. <br />Related State Statutes: ORS 279A.065 & ORS 279B.065 <br /> <br /> <br />137-047-0270. Intermediate Procurements <br />1) Generally. For Procurements of Goods or Services greater than the dollar amount stated in <br />ORS 279B.065 and less than or equal to the higher dollar amount stated in ORS 279B.070, <br />a Contracting Agency may Award a Contract as an intermediate Procurement pursuant to <br />ORS 279B.070. <br />2) Negotiations. A Contracting Agency may negotiate with a prospective Contractor who offers <br />to provide Goods or Services in response to an intermediate Procurement to clarify its quote <br />or Offer or to effect modifications that will make the quote or Offer acceptable more <br />Advantageous to the Contracting Agency. <br />3) Amendments. A Contracting Agency may amend a Public Contract Awarded as an <br />intermediate Procurement in accordance with Rule 137-047-0800, but the cumulative <br />amendments may not increase the total Contract Price to a sum that exceeds the higher <br />dollar amount stated in ORS 279B.070 or one hundred twenty-five percent (125%) of the <br />original Contract Price, whichever is greater. <br />Related State Statutes: ORS 279A.065 & ORS 279B.070 <br /> <br /> <br />137-047-0275. Sole-Source Procurements <br />1) Generally. A Contracting Agency may Award a Contract without competition as a sole- <br />Source Procurement pursuant to the requirements of ORS 279B.075.
