A faCility permit from the Lane County Public Works Department is required <br />for any new driv~,way access or modification of an existing access. <br /> <br />3. A special use permit is required for placement of the proposed use within a <br />deSignated floodway. <br /> <br />4. This permit must be implemented (i.e. substantial construct,ion <br />accomplished) within two years of the date of approval. An extension of <br />time may be granted without an additional hearing if the Hearings Official <br />receives a written request from the applicant prior to the expiration' of <br />thi s condition. <br /> <br />Justification for D~cision (Conclusion) <br /> <br />I .' P LAN CONFORMITY <br /> <br />The ,Metro Plan designates the property as Sand and Gravel andi s zoned E-30. <br />Environmental Resources Element Policy #l1c (page III-C-8) indicates that open <br />space uses and agricultural uses are appropriate uses for land designated Sand <br />and Grave 1 . <br /> <br />Willamette River Greenway Policy #9 (page III'-O-5) requires' that local <br />refihement plans and implementing ordinances be applied to the specific use <br />management considerations of Statewide Planning Goal #15, when not otherwise <br />addressed by the Metro Plan. <br /> <br />Compliance, with, the Willamette River Greenway policies of the Rural <br />Comprehensive Plan shall be addressed through affirmative compliance with the <br />criteria of Lane Code 16.254(4). <br /> <br />The Hearings Official concludes that the proposed golf course is consistent with <br />the relevant policies of the Metro Plan. <br /> <br />II. ZONE CONFORMITY <br /> <br />Lane Code 16.254(3) requires that new intensifications, changes or use or <br />developments allowed in applicable zones obtain a greenway development permit. <br />Lane Code 16. 254( 4) further requ i res that such deve 1 opment con form to the <br />following criteria: <br /> <br />(i) Thedevefopment protects or enhances the eXisting vegetative fringe <br />between the actiVity and the river. Where such protective action is <br />shown to be impractical under the circumstances, the maximum <br />landscaped area or open space shall be provided between the activity and <br />the river and the development provides for the reestablishment of <br />vegetative cover where it will be significantly removed dt.lriog the <br />process of land development. <br /> <br />The property has been historically cultivated up to the top of the river <br />bank and therefore the vegetative fringe does not extend beyond that <br />
